Universals (pol. uniwersały) – normative acts of an executive or information nature adopted by the Permanent Council (pol. Rada Nieustająca) in 1775–1788 – constitute an important, though not yet widely discussed in the literature, aspect of its activity. They were addressed to the indicated group of entities: central and local offices, courts, civil and military authorities, magistrates or residents of specific lands and voivodships. Universals, issued between the sessions of the Sejm, enabled the Council to systematically organize and regulate matters not reserved for the legislative authority. The general scope of the universals included, among others, the problems of the court system, substantive and procedural law, economy, social and educational policy, and border issues.

Uniwersały – akty normatywne o charakterze wykonawczym lub informacyjnym uchwalane przez Radę Nieustającą w latach 1775–1788 – stanowią istotny, choć nieomawiany dotąd szerzej w literaturze aspekt jej działalności. Adresowano je do określonej grupy podmiotów: urzędów centralnych i lokalnych, sądów, władz cywilnych i wojskowych, magistratów lub mieszkańców konkretnych ziem i województw. Uniwersały, wydawane między obradami sejmu, umożliwiały Radzie bieżące porządkowanie i regulowanie materii niezarezerwowanych dla władzy ustawodawczej. Zakres przedmiotowy uniwersałów obejmował między innymi problematykę: ustroju sądów, prawa materialnego i procesowego, gospodarki, polityki społecznej i edukacyjnej oraz spraw granicznych.

The matters most frequently discussed in the universals of the Permanent Council, apart from the issues of the judiciary and judicial law, were matters related to economics. Particular emphasis was placed on the functioning of royal cities under the supervision of the Police Department of the Permanent Council, including control over the course of propination auctions. In single universals, the Council focused its attention, among others, on the issues of road infrastructure, agriculture, forestry, the raw materials industry, trade and treasury.

Obok problematyki sądownictwa i prawa sądowego, materią najczęściej poruszaną w uniwersałach Rady Nieustającej były sprawy z zakresu ekonomii. Szczególny nacisk położono na kwestie funkcjonowania miast królewskich, znajdujących się pod dozorem Departamentu Policji Rady Nieustającej, w tym kontroli nad przebiegiem licytacji propinacyjnych. W pojedynczych uniwersałach Rada skupiła swoją uwagę m.in. na problematyce: infrastruktury drogowej, rolnictwa, leśnictwa, przemysłu surowcowego, handlu i skarbowości.

The court system, functioning of courts and – to a lesser extent – land law were repeatedly the subject of universals (pol. uniwersały) of the Permanent Council (pol. Rada Nieustająca). The reasons were the absence of sufficient legal regulations, and above all no comprehensive codifi cation, which caused problems for the entire judicial system and was a source of controversy reported to the Permanent Council through reports and memorials. Universals were addressed to courts, offices, as well as participants in court disputes. Their purpose was to clarify unclear, questionable law and to improve the operation of justice. The detailed issues regulated in the universals were supervision of courts and the obligation to submit court reports, the problem of completing court members, determining the jurisdiction of courts, rules of arbitration and enforcement proceedings, including soldiers participation in the so-called traditio of estates.

Ustrój i funkcjonowanie sądów oraz – w mniejszym stopniu – ziemskie prawo sądowe wielokrotnie stanowiły przedmiot uniwersałów Rady Nieustającej. Przyczyn jej zainteresowania tą materią należy upatrywać w braku wystarczających regulacji prawnych, przede wszystkim kompleksowej kodyfikacji, co skutkowało problemami całego systemu sądownictwa i było źródłem kontrowersji zgłaszanych Radzie w drodze memoriałów lub raportów sądowych. Uniwersały adresowano zarówno do sądów, urzędów, jak i do uczestników sądowych sporów, a ich celem było doprecyzowanie niejasnych, budzących wątpliwości praw i usprawnienie działania wymiaru sprawiedliwości. Do szczegółowych zagadnień regulowanych w uniwersałach poświęconych tej materii należała przede wszystkim kwestia nadzoru nad sądami i obowiązku nadsyłania przez nie raportów, problem kompletowania składów sędziowskich, ustalania właściwości sądów, zasad funkcjonowania sądów polubownych oraz postępowanie egzekucyjne, w tym udział wojska przy tzw. tradycji dóbr ziemskich.

In addition to judicial and economic matters, the activities of the Permanent Council focused on widely understood social policy, namely: student recruitment to the Academy of Medicine in Cracow, the prevention of begging, vagrancy and escape of the peasants from Russia. Furthermore, the Permanent Council was acting in an area of education and issued the universals devoted to raising funds for the Commission of National Education. The actions of the Permanent Council were not always effective, because the local authorities and the nobility did not want to comply with regulations contained in the universals.

Obok materii sądowniczych i ekonomicznych działania Rady Nieustającej koncentrowały się wokół szeroko rozumianej polityki społecznej: rekrutacji studentów do Akademii Lekarskiej w Krakowie, zapobiegania żebractwu, włóczęgostwu i zbiegostwu chłopów z Rosji. Ponadto Rada Nieustająca działała w obszarze edukacji – wydawała uniwersały poświęcone gromadzeniu funduszy dla Komisji Edukacji Narodowej. Działania Rady Nieustającej nie zawsze były jednak skuteczne, bowiem władze miast i szlachta nie chciały podporządkować się nakazom zawartym w uniwersałach.
