Wprowadzone przez ustawodawcę zmiany deregulacyjne w obszarze zawodu urbanisty stawiają urbanistów przed koniecznością podjęcia działań w zakresie reorganizacji samorządu zawodowego. Ponadto urbanista - jak i cały samorząd - staje w obliczu drastycznych przemian, a to skłania do refleksji na temat ich zasadności, oceny stanu normatywnego i wysunięcia wniosków zarówno de lege lata jak i de lege ferenda.

The authors of the article have made an attempt to provide an analysis of the legislative changes concerning the profession of city urban planner, introduced by the Act of 9th May 2014 regarding the facilitation of access to certain regulated professions. A comparison of the legal status prior to the deregulation with the current state of affairs leads to conclusions de lege ferenda in the context of deregulatory measures. The text provides an evaluation of measures taken by the professional association of city planners and architects from the standpoint of their legitimacy and protection of public objectives, as well as constitutional principles and EU law. The text attempts to classify short- and long-term objectives for the urban planners’ professional association; reorganization aspects and conducting activities in other forms have been noted. In addition to conclusions on the necessity of reestablishing the professional association of urban planners, it has been pointed out that the current deregulatory measures satisfy constitutional rules with regard to the recognition of acquired rights for conducting professional activities, i.e. preparation of drafts of: plans, studies and decisions regarding development conditions.

Niniejszy artykuł opisuje uregulowania prawne dotyczące zawodu urbanisty w Polsce, w latach 1945-2014. Artykuł został podzielony na 4 rozdziały, z których każdy obejmuje dany okres historyczny odpowiadający przedziałowi czasowemu obowiązywania poszczególnych ustaw regulujących kwestię zagospodarowania przestrzennego. W publikacji autor szczególną uwagę zwraca na te przepisy prawne odnoszące się do prawa do wykonywania zawodu, a więc tych czyniących zawód ten otwartym bądź zamkniętym. W końcowej części autor dokonał zwięzłej analizy tzw. ustawy deregulującej - ustawy likwidującej dotychczasowe wymogi prawne do wykonywania zawodu urbanisty oraz likwidującej samorząd urbanistów.

it has to be born in mind that the problem which concerns the issue of the right to exercise the town planner profession is very up to date in Poland because of the draft of legislative amendments which propose the abolition of formal rules for exercising this profession. Aforementioned draft is popularly named ’deregulation act’. In its basic concept the draft moves towards liberalization of the access to the planner profession. When discussing the legal provisions related to the acces to planner profession, it has to be noted that this issue had experienced different approaches in Polish legal system. Hence, the Author of this article described the evolution in the approach to the administrative and legal regulation of access to planner profession in the period 1945-2014. In order to show the evolution in the above mentioned approach, and show loopholes in provisions which regulate this issue, the article was divided into 4 chapters, each describes the provisions which, in their period of binding in force, regulated prerequisites which one should met in order to has the right to exercise the planner profession. In the last part of the article its author made the summary and legal analysis of the so-called ’deregulation act’.

Przygotowanie zawodowe osób mogących być urbanistami w nowej rzeczywistości prawnej, która powstała w 2014 roku, jest zdecydowanie niewystarczające do prowadzenia prac planistycznych. Absolwenci studiów pierwszego stopnia kierunku architektura i urbanistyka oraz gospodarka przestrzenna mogą bez żadnej praktyki z zakresu planowania przestrzennego wykonywać plany zagospodarowania przestrzennego na poziomie gminy i województwa, podczas gdy wiedza teoretyczna i praktyczna takich osób jest niewielka.

After the deregulation of the profession of urban planner, Local Plans of Spatial Development and Regional Plans of Spatial Development can be prepared not only by those, who were registered / not registered in the Chamber of Town Planners and being authorized town planners, but also by those, who have limited theoretical and practical knowledge on the issue. Completing a Bachelor’s degree in Architecture and Town Planning as well as in Spatial Development does not guarantee good preparation for the profession of town planner. Ministerial educational standards define the extent of knowledge to be acquired by graduates of Architecture and Town Planning courses and indicate that they should be prepared to perform the function of assistant planner. In terms of Spatial Development course there is no defined educational standards. In practice, each university determines individual programs of study and the material taught to the students depends on the teaching staff. According to a survey among students, graduates of Bachelor’s degree in Architecture and Town Planning believe that their practical knowledge is too limited to be able to prepare Local Plans of Spatial Development and Regional Plans of Spatial Development without assistance. Improvement in terms of the preparation of graduates to perform the profession of a planner can be achieved by introducing changes in the educational standards, such as an increase in scope of the material covered during academic courses and gaining practice in proper spatial development planning offices.
