Rozdzielność majątkowa z wyrównaniem dorobków została wprowadzona do Kodeksu rodzinnego i opiekuńczego w 2005 r. Ustrój ten nie jest jednak popularny. Przyczyną tego może być fakt, że obowiązujące przepisy nie są rozbudowane, a dodatkowo wywołują wiele wątpliwości. W niniejszym artykule w pierwszej kolejności omówiono obowiązującą regulację. Następnie wskazano na obce rozwiązania, które dotyczą omawianego modelu ustroju. Końcowa część artykułu poświęcona jest kierunkom zmian, jakie być może pozwolą uczynić omawiany ustrój bardziej atrakcyjnym dla małżonków.

Separation of assets with equalization of accrued gains was introduced to the Family and Guardianship Code in 2005. However the regime is not popular. The reason for the lack of popularity is the fact that the provisions regarding the regime are not comprehensive and are a source of many doubts. In this article the current regulation has been discussed. Furthermore foreign solutions concerning this model of regime have been presented. The final part of the article shows the directions of amendments which could make the regime more attractive.
