Artykuł poświęcony jest uszkodzeniu pistoletu WALTHER P99 kal. 9 mm w trakcie oddawania strzałów i konieczności rewizji, na podstawie badań, instrukcji użytkowania tej broni.

The aim of this article is to warn against the possible injury hazard for the shooter, resulting from the wear of the components of weapon during dry firing. The analyzed case presents the damages to a gun caused by multiple dry firing, i.e. without a cartridge in the chamber. As a consequence of the shots, the breech face of the pistol was damaged. Therefore, it should be considered to categorically ban dry firing with WALTHER P99 pistol.

The article covers the analysis of statutory marks of an administrative offence of destruction or damage to devices constructed for protection of sea shores and inland waters. This is an interesting type of a prohibited act that involves causing an abstract threat to the protected goods. The doctrine considers such acts to be ineffective, but the author believes that the act under analysis is of effective nature. Due to the construction of the type of offence, it causes difficulties on the basis of the overlap of the provisions of the act. Settlement of the Article 81 takes place on the grounds of the so-called rules for excluding a multiplicity, including both logical and teleological rules of interpretation.

Artykuł obejmuje analizę ustawowych znamion wykroczenia niszczenia lub uszkadzania urządzeń służących do ochrony brzegów wód morskich lub śródlądowych. Jest to ciekawy typ czynu zabronionego polegającego na wywołaniu czyny za bezskutkowe, jednak Autor twierdzi, że analizowany czyn ma charakter skutkowy. Z uwagi na konstrukcję typu wywołuje on trudności na gruncie zbiegu przepisów ustawy. Ich rozstrzygnięcie następuje na gruncie tzw. reguł wyłączania wielości, z uwzględnieniem zarówno logicznych, jak teleologicznych zasad wykładni.
