The article refers to the offence of fixation of the image of the naked person. The author tried to consider the issue of a possibility of image recognition when there was no information medium on which the image should be saved. In addition, the problem of significance of right to intimacy under art. 191a of the Penal Code was discussed. The act of playing of the image as a requirement to realize the feature of “fixation of the image” was also worth noting. Furthermore, the features of “violence” and “threat” were analyzed due to the type of resources used by the perpetrator to commit this offence. Finally, the matter of qualifying this act as an attempt to commit an offence was raised.

Przedmiotem komentowanej glosy są zagadnienia związane z przestępstwem utrwalenia nagiego wizerunku. Ponadto została poruszona kwestia możliwości jego rozpoznawalności w przypadku, gdy dane nie zostały zapisane na nośniku informacji. Podjęto również problem odtwarzania wizerunku ze względu na realizację znamienia „utrwalenia wizerunku”. Co więcej, autor podjął się analizy znaczenia prawa do intymności na gruncie art. 191a k.k. Dodatkowo zostały omówione znamiona „przemocy” oraz „groźby” z uwagi na rodzaj środków, którymi posługuje się sprawca do dokonania tego czynu. Na koniec dokonano oceny zakwalifikowania wspomnianego czynu jako usiłowanie przestępstwa.

The aim of this work is to analyze the crime of fixing and distributing the image of a naked person or a person during the sexual act. On the basis of the analysis, the author will answer the question whether the introduction of the offence referred to in Article 191a of the Polish Penal Code was necessary and appropriate, and additionally, whether – according to the legislator’s assumptions – this regulation will counteract the increase of this phenomenon.

Celem niniejszego opracowania jest analiza przestępstwa utrwalania i rozpowszechniania wizerunku nagiej osoby lub osoby w trakcie czynności seksualnej. Na jej podstawie autor sformułuje odpowiedź na pytanie, czy wprowadzenie przestępstwa określonego w przepisie art. 191a k.k. było zabiegiem słusznym i koniecznym. Ponadto oceni, czy analizowana regulacja stała się, zgodnie z założeniami ustawodawcy, remedium na przeciwdziałanie wzrostowi tego zjawiska.

W artykule autor charakteryzuje problematykę rejestrowania oraz rozpowszechniania wizerunku i głosu wyborców oraz członków obwodowych komisji wyborczych. Wśród omawianych zagadnień znalazły się: zasada tajności głosowania, mężowie zaufania, obserwatorzy społeczni, obserwatorzy międzynarodowi, pojęcie wizerunku, jego naruszenia oraz rozpowszechniania, wyborca jako szczegół całości, pojęcie zgromadzenia, problematyka utrwalania wizerunku wyborcy a ograniczenie jego praw obywatelskich w świetle Konstytucji RP oraz RODO, jak również okoliczności uchylające bezprawność utrwalania wizerunku wyborcy oraz członków obwodowych komisji wyborczych.

In the article, the author describes the problem of registering and distributing the image and voice of voters and members of the electoral commissions. Among the issues discussed were the principle of secrecy of voting, scrutineer, social observers, international observers, the concept of image, its violation and distributing, the voter as a detail of the whole, the concept of gathering, the issue of preserving the image of the voter and limiting his civil rights in the light of the Constitution of the Republic of Poland and RODO as well as circumstances repealing the illegality of perpetuating the image of the voter and members of the electoral commissions.
