Wolność nauczania a autonomia edukacji akademickiej zgodnie z ustawą 2.0

Artykuł został poświęcony zagadnieniu autonomii edukacji akademickiej. Do rozważenia tytułowego zagadnienia prowadzi analiza uwarunkowań faktycznych i prawnych przyjęcia tzw. Konstytucji dla Nauki oraz praktyki wykładni i stosowania jej w zakresie prowadzenia studiów. W ten sposób celem pracy staje się ustalenie, czy reguły prawne tworzenia programów studiów obowiązujące od roku akademickiego 2019/2020 zapewniają uczelniom wyższym w tym zakresie niezbędną autonomię instytucjonalną oraz gwarantującą wolność nauczania. W konkluzjach pracy stwierdza się, że przyjęta regulacja w odpowiedni sposób realizuje autonomię programową uczelni wyższej. Przeprowadzone analizy wykazują, że przyjęte rozwiązania odpowiednio równoważą wymóg ochrony interesu publicznego z potrzebą reagowania na potrzeby partnerów społeczno-gospodarczych uczelni wyższych. W ten sposób równoważy się jakość kształcenia względem konieczności wprowadzania do programów studiów nowych treści programowych, odpowiadających na wyzwania stawiane współcześnie absolwentom uczelni wyższych.

The issue of work is the autonomy of academic education. Analyzing the factual and legal conditions for adopting the so-called Constitution for Science and applying Act 2.0. in the field of conducting studies leads to considering the presented issue. In this way, the work aims to determine whether legal rules of creating studies curricula, in force since the 2019/2020 academic year, provide universities with the necessary institutional autonomy and guarantee freedom of teaching. The work concludes that the adopted regulation adequately realizes the autonomy of academic education. The analyses show that the adopted solutions enough balance the requirement to protect the public interest and the need to respond to the needs of the socio-economic partners of higher education institutions. In this way, the quality of education is balanced with the need to introduce new curricular content into the programs of study, responding to the challenges of today’s university graduates.

Postrzeganie realizacji wolności akademickiej przez nauczycieli akademickich w Polsce

Wychodząc od teorii postrzegania praw człowieka i wolności podstawowych, artykuł identyfikuje rodzaje naruszeń wolności akademickiej w polskich szkołach wyższych oraz cechy nauczycieli akademickich i typ uczelni, których te naruszenia najczęściej dotyczą. W opracowaniu zostały wykorzystane podstawowe miary statystyki opisowej, a także metoda najmniejszych kwadratów. Badanie ujawnia, że bardziej pozytywnie postrzegają realizację wolności akademickiej nauczyciele akademiccy zatrudnieni na stanowisku profesora i profesora uczelni. Natomiast w największym stopniu naruszenia odczuwają osoby zajmujące niższe stanowiska z długim stażem pracy. Nauczyciele akademiccy zatrudnieni w uczelniach o długiej tradycji kształcenia pozytywniej odczuwają realizację wolności akademickiej niż ich koledzy zatrudnieni w uczelniach o krótkiej tradycji kształcenia.

Stemming from the theory of the perception of human rights, the article identifies the main types of violations of academic freedom in Polish universities, the features of scientists, and the type of university the most often affected by these violations. The methods involve basic descriptive statistics measures and ordinary least squares regression. The study reveals that perceived academic freedom is higher for full professors or university professors than for assistant professors. The highest violations are felt by scientists holding lower academic positions but with long work experience. Academics employed at universities with a long tradition of education perceive the implementation of academic freedom more positively than their colleagues employed at universities with a short tradition of education.
