W niniejszym artykule przedmiotem rozważań będą z jednej strony przyczyny powsta-wania wtórnej konstytucyjności w wyniku wejścia w życie wyroku Trybunału Konsty-tucyjnego. W kontekście tego zagadnienia należy wziąć, po pierwsze, pod uwagę zasadę skargowości, która może prowadzić do jedynie fragmentarycznego eliminowania nie-konstytucyjności, a to z kolei do powstania bardziej negatywnych konsekwencji niż obo-wiązywanie niekonstytucyjnej normy. Po drugie, wydaje się, że niebagatelne znaczenie ma rodzaj orzeczenia TK, który stanowi podstawę do klasyfikowania normy jako wtór-nie niekonstytucyjnej. Z drugiej strony analizowane będą możliwości zapobiegania tego stanu przez Trybunał. Powstaje pytanie, czy Trybunał może łagodzić skutki zasady skar-gowości, tzn. czy może modyfikować zakres zaskarżonych przepisów. Niezależnie od tego większym potencjałem jako środki zapobiegające wtórnej niekonstytucyjności charakte-ryzują się instrumenty umożliwiające uelastycznianie skutków stwierdzenia niekonsty-tucyjności. Warto zaznaczyć, że część z podejmowanych przez Trybunał zabiegów jest kwestionowana w literaturze.

In this article, on the one hand the subject of consideration will be the reasons of com-ing into being the secondary unconstitutionality as a consequence of entry into force a judgment of the Constitutional Tribunal. In the abovementioned context, we should first take into account the principle of accusatorial procedure, which may lead to mere-ly piecemeal elimination of unconstitutionality. In turn, it may effect coming into be-ing more negative consequences than being into force unconstitutional provision. Sec-ondly, it seems that the type of judgment of the Constitutional Tribunal, which is the basis for classifying the norm as secondary unconstitutional, is of considerable impor-tance. On the other hand, possibilities of prevention the secondary unconstitutionality by the Tribunal will be analysed. The question is, whether the Tribunal is able to miti-gate the consequences of the principle of accusatorial procedure, particularly whether it is able to modify the scope of the challenged provisions. Regardless of this, judiciary in-struments, which enable to form the consequences of the judgment of the Constitution-al Tribunal flexibly, seem to be more effective as measures to prevent secondary uncon-stitutionality. It is worth noting that some of this measures taken by the Tribunal are questioned in the literature.
