The article presents an analysis of the normative solutions regarding support for a care of a person with a disability. It takes into account the changes introduced by the provisions of the Act on Supporting Benefits, which create a new system of care benefits from 1 January 2024 encompassing financial support exclusively for carers of people under the age of 18 with disabilities. The legislator simultaneously decided to leave the possibility of setting the care benefits after 1 January 2024 on the basis of the provisions in force up to 31 December 2023. However, the accepted duality of the solutions on this is difficult to justify because of the different treatment of carers of people with disabilities, because their right to a care benefit is determined by the moment that the application is filed. Similarly, the moment that the application is filed for a nursing benefit and consequently the procedure in which the case is handled determines whether it is possible for the carer of a person with a disability to take up gainful employment.

Artykuł został poświęcony tym aspektom systemu opieki długoterminowej nad osobami niesamodzielnymi, które wpływają na przyszłą sytuację emerytalną opiekunów nieformalnych (najczęściej rodzinnych). W pierwszej części zostało pokazane, jak sprawowanie opieki wpływa na możliwości aktywności zawodowej opiekuna i tym samym może ograniczać jego perspektywy emerytalne. W drugiej części został omówiony – również pod kątem zabezpieczenia emerytalnego – system świadczeń dla osób będących poza zatrudnieniem ze względu na sprawowanie opieki. Rozważania te prowadzą do wniosku, że ustawy o świadczeniach rodzinnych i o pomocy społecznej zawierają regulacje, które nie wystarczają do dostatecznego zabezpieczenia emerytalnego znacznej części opiekunów. Autor analizuje też fakt, że część opiekunów decyduje się na opuszczenie rynku pracy (włącznie z konsekwencjami dla bezpieczeństwa emerytalnego) i uwarunkowania tej sytuacji. Rozważania te służą także sygnalizowaniu wyzwań, z jakimi musi zmierzyć się ustawodawca, by zwiększyć szanse opiekunów na bezpieczeństwo socjalne w okresie starości. Omówione zostały również dotychczasowe próby umożliwienia aktywności zawodowej opiekunów w rodzimej polityce publicznej. Całość wieńczą wnioski i rekomendacje.

The article deals with those aspects of the long-term care system that have an influence on the future situation of carers as pensioners. In the first part, it is shown and analysed how informal care can affect the working possibilities of a caregiver and thus their social security in old age. Next, elaborated is the Act on family benefits and the Act on social assistance, regarding the issues entitlement to social security. This considerations lead to the conclusion that the contemporary law does not protect the social security of carers and former carers in old age. Then, there are analysed some of the preconditions for why many carers in Poland leave the labour market. Evaluated are the challenges to be faced in order to strengthen the pension security of informal carers. The author also analyses some legislative attempts to tackle the problem of the exclusion of informal carer from the labour market. The final part of the article constitutes the conclusions drawn and the recommendations made.
