More and more often, minors who cannot manage their property on their own are becoming owners of real estate. Their parents are usually not aware of the limitations related to the disposal of real estate owned by their children, which in practice requires them to be taken into account by legal protection authorities, including notaries. The article presents selected issues concerning the management of real estate owned by a minor. Particular attention was paid to the activities of the minor's property management involving the participation of a notary. At the same time, the basic issues related to granting permission for parents to perform activities exceeding the scope of day-to-day management of real estate and restrictions on the management of a child's real estate by their parents were discussed.

The aim of the article is to analyze the court practice in adjudicating on the authorization to provide health services to an adult patient. In the first part, interpretation problems regarding the legal regulations of this consent, reported in the doctrine of medical law, were signaled. In the second part, these problems are juxtaposed with the results of an empirical (file) study covering court proceedings for authorization to provide health services. In conclusion, detailed comments on judicial practice were formulated, including, inter alia, specifying the circle of participants in the proceedings, the manner of taking evidence and formulating the operative part of the judgment, and the desirability of maintaining the current model of the discussed court proceedings was questioned. It seems that in many cases it would be more functional for doctors themselves to make decisions on medical consent.

Artykuł ma na celu analizę praktyki sądowej w zakresie orzekania o zezwoleniu na udzielenie świadczenia zdrowotnego dorosłemu pacjentowi. W pierwszej części zasygnalizowane zostały problemy interpretacyjne dotyczące prawnych unormowań tej zgody, zgłaszane w doktrynie prawa medycznego. Problemy te zestawiono w drugiej części z wynikami badania empirycznego (aktowego) obejmującego postępowania sądowe o zezwolenie na udzielenie świadczenia zdrowotnego. W konkluzji sformułowano uwagi szczegółowe dotyczące praktyki sądowej, obejmujące m.in. określenie kręgu uczestników postępowania, sposób prowadzenia postępowania dowodowego i formułowania sentencji orzeczenia, oraz podano w wątpliwość celowość utrzymania obowiązującego modelu omawianych postępowań sądowych. Jak się wydaje, w wielu przypadkach bardziej funkcjonalne byłoby podejmowanie decyzji w przedmiocie zgody medycznej przez samych lekarzy.

The article deals with the issue of the leave of the court to perform activities exceeding the common management of the child’s property. The premise of the article is to demonstrate that the current regulation of art. 101 § 3 of the Family and Guardianship Code, containing imprecise conditions for its application, causes growing doubts in the doctrine and jurisprudence, overburdening family court departments, does not comply with Western European standards and makes the conduct of legal transactions involving minors extremely onerous. As a result of significant civilization changes which have taken place in Poland over the last few decades, a discussion should be initiated on the creation of a closed catalog of activities related to the management of a child.s property, for which control of the court is required.

The condition for the provision of health services is patient’s consent. The basis for its granting is reliable information provided by the doctor in a manner understandable to the recipient. Based on the information provided, the patient makes his own decision on the use of the health service or refuses to make use of this possibility. This does not apply to minors for whom the decision is made by parents or other entities exercising custody over him. In the event of disagreement with the provision of health services, despite the existence of medical indications or in the event of a conflict of positions of entities authorized to express it, the initiative is taken over by the guardianship court.

Warunkiem udzielenia świadczenia zdrowotnego jest zgoda pacjenta. Podstawą jej udzielenia jest rzetelna informacja przekazana przez lekarza w sposób zrozumiały dla odbiorcy. W oparciu na przekazanych informacjach pacjent samodzielnie podejmuje decyzję o skorzystaniu ze świadczenia zdrowotnego albo odmawia skorzystania z takiej możliwości. Nie dotyczy to małoletnich, za których decyzję w tym zakresie podejmują rodzice albo inne podmioty sprawujące nad nim pieczę. W przypadku niewyrażenia zgody na udzielenie świadczenia zdrowotnego, pomimo istnienia wskazań lekarskich albo w przypadku konfliktu stanowisk podmiotów uprawnionych do jej wyrażenia, inicjatywę przejmuje sąd opiekuńczy.
