There are a number of similarities between environmental and climate protection legislation, but these two areas also have their own objectives. Even so, these objectives are similar and there are interdependencies and synergies between them, and in some cases the measures to achieve them compete. Efforts to achieve climate goals in both greenhouse gas reduction and climate change adaptation directly benefit from the existence and quality of environmental components – however, some climate measures conflict with environmental protection. In the present paper, I address the competing public interests in the two areas concerned and raise their possible symbiosis. Furthermore, I discuss the concept of public interest, or the prevailing public interest, in using renewable energy source, in connection with the regulations currently under discussion at the EU level.

V právní úpravě ochrany životního prostředí a ochrany klimatu existuje řada podobných prvků, ale obě oblasti mají také vlastní cíle. Ty jsou na jedné straně podobné a je mezi nimi vzájemná provázanost a synergie, v některých případech si ale opatření k jejich naplnění konkurují. Snaha o dosažení klimatických cílů v oblasti snižování emisí skleníkových plynů i v oblasti přizpůsobení se změně klimatu přímo benefituje z existence složek životního prostředí a jejich kvalitního stavu. Některá klimatická opatření se však dostávají s ochranou životního prostředí do konfliktu. V předloženém příspěvku se zabývám konkurencí veřejných zájmů v obou dotčených oblastech, respektive jejich možnou symbiózou. Dále se ve spojení s aktuálně projednávanými předpisy na úrovni EU zabývám pojetím veřejného zájmu, respektive převažujícího veřejného zájmu na využití obnovitelných zdrojů energie.
