The justification of the bill on the amendment of the Constitution must be attached every time the petitioner files a bill on the amendment of the Constitution to the Sejm. The regulations of the Sejm in the art. 34 § 2 stipulate the required provisions of the justification. Lack of justification with regard to the bill on the amendment of the Constitution will cause the Speaker of the Sejm to return the petition and require the petitioner to complete it. In the event of a failure to complete the justification, the right of legislative initiative on the amendment of the Constitution will not commence the legislative process. Justification to the bill on the amendment of the Constitution is obligatory to initiate the legislative proceedings in the Sejm.

Uzasadnienie projektu ustawy o zmianie Konstytucji musi być załączone za każdym razem, gdy wnioskodawca składa projekty ustawy o zmianie Konstytucji do Sejmu. Regulamin Sejmu w art. 34 ust. 2 określił, co powinno zawierać uzasadnienie. Brak uzasadnienia do projektu ustawy o zmianie Konstytucji skutkuje tym, że Marszałek Sejmu może zwrócić projekt wnioskodawcy celem uzupełnienia. Nieuzupełnienie braków w uzasadnieniu powoduje, że inicjatywa ustawodawcza o zmianie Konstytucji nie rozpoczyna procesu ustawodawczego. Uzasadnienie do projektu ustawy o zmianie Konstytucji jest koniecznym elementem do wszczęcia procedury ustawodawczej w Sejmie.

Konstytucja RP z 1997 r. przewiduje – zależnie od interpretacji – jeden, trzy lub cztery przypadki wyższych większości głosów w parlamencie niż te właściwe dla jej zmiany. Celem artykułu jest określenie racji, jakie mogły stać za przyjęciem takiej gradacji wymogów większościowych, oraz ich ocena w kontekście aksjologii demokracji. Mając świadomość, że poziom trudności związanych z podejmowaniem przez parlament decyzji wynika z uwarunkowań zarówno prawnych – proceduralnych i materialnych – jak i pozaprawnych, przekonuję, że precyzyjne matematyczne hierarchizacje w tym zakresie są niemożliwe lub nieprzekonujące. Większość głosów pozostaje jednak podstawowym kryterium określającym poziom trudności tych decyzji, podkreślając rolę, jaką w przetrwaniu demokracji odgrywają mniejszości. W kontekście zniekształceń procesu wyborczego, wpływających na reprezentatywność parlamentu, wymóg większości kwalifikowanej może być także traktowany jako zapewniający, że przyjmowane nią decyzje rzeczywiście odzwierciedlają wolę większości wyborców, oraz wzmacniający ich prawomocność. W państwie demokratycznym istnieją jednak takie wartości, które nie mogą być uchylone nawet przez najwyższe większości.

The 1997 Constitution of Poland provides for one, three or four instances – depending on the interpretation – for the parliamentary majority of votes higher than that required for amending that Constitution. The aim of this paper is to specify the reasons that might have guided the Constitution-makers in adopting such a gradation, and to analyse those regulations in the light of democratic axiology. Nonetheless the difficulties related to adopting decisions by the parliament result both from legal (procedural and material) and non-legal factors, majority of votes remains a basic criterion specifying the level of those difficulties, underlying the role that the minority plays in democracy. In the context of electoral process’ distortions qualified majority may also be seen as ensuring that parliamentary decisions indeed reflect the will of the voters’ majority. In a democratic state there are, however, such values that cannot be eliminated even by the highest majorities.
