Celem artykułu jest przedstawienie sposobu definiowania zasady niedziałania prawa wstecz przez Trybunał Konstytucyjny, w tym sposobu uzasadniania obowiązywania zasady lex retro non agit jako zasady mającej szczególnie doniosłe znaczenie prawne wśród dyrektyw legislacyjnych. Analiza orzecznictwa pokazuje, że Trybunał Konstytucyjny od początku uznawał zasadę lex retro non agit za podstawową i kluczową zasadę porządku prawnego wywodząc ją z takich wartości jak bezpieczeństwo prawne, pewność obrotu prawnego i poszanowanie praw nabytych. O ile pierwsza definicja przedstawiała wąskie rozumienie retroaktywności, o tyle w kolejnych orzeczeniach TK rozszerzył zakres rozumienia zasady lex retro non agit, wskazując jednocześnie w jakich okolicznościach prawodawca może odstąpić od zakazu retroaktywności.

The aim of the article is to present the way in which the Constitutional Tribunal defines the principle of non-retroactivity of law, including the way in which the principle of lex retro non agit is underestood as a principle of particularly significant legal significance among legislative directives. The analysis of the case law shows that the Tribunal recognized this principle, from the beginning, as a fundamental principle of the legal order, derived from such values as legal security, certainty of legal transactions and respect for acquired rights. While the first definition presented a narrow understanding of retroactivity, in subsequent rulings the Constitutional Tribunal extended the scope of understanding of the principle of lex retro non agit and at the same time it indicated the circumstances that let the legislator depart from the prohibition of retroactivity.
