The issue concerning the principles of constitutional law has a special dimension because their role is not confined only to this branch of law. They are the principles of the whole legal order. The doctrine of constitutional law deals with the problems of law principles, yet its representatives have highly divergent views on many questions, in particular regarding the constitutional principle of law, the catalogue of principles, or their ontological status. The subject of interest of constitutionalists is first of all the content analysis of individual constitutional principles. Many questions are left to law theorists, the reference to the findings of the Polish law theory or to concepts defined as “external” (developed within the world’s law theory and philosophy) being comparatively rare. The law doctrine and judicial decisions regard the principle of appropriate vacatio legis as a constitutional one. It was derived by the Polish Constitutional Tribunal from the principle of democratic state under the rule of law through the principle of protection of citizens’ trust in the state and the laws it establishes. Although this principle is not explicitly expressed in Poland’s Constitution of 2nd April 1997, its position as a constitutional principle is not challenged. The principle of appropriate vacatio legis satisfies the requirements of the doctrine expected from law principles, it has a strong axiological justification associated with the need to ensure legal security, and it is deeply rooted in cultural-legal tradition.

Problematyka zasad prawa konstytucyjnego ma wymiar szczególny, gdyż ich rola nie ogranicza się wyłącznie do tej gałęzi prawa. Są one jednocześnie zasadami całego porządku prawnego. Doktryna prawa konstytucyjnego podejmuje problematykę zasad prawa, jednak w wielu kwestiach wśród jej przedstawicieli panuje znaczna rozbieżność poglądów, zwłaszcza odnośnie do pojęcia konstytucyjnej zasady prawa, katalogu zasad czy ich statusu ontologicznego. Przedmiotem zainteresowania konstytucjonalistów jest przede wszystkim analiza treściowa poszczególnych zasad konstytucyjnych. Wiele kwestii jest pozostawionych teoretykom prawa, przy czym powoływanie się na ustalenia polskiej teorii prawa czy na koncepcje określane jako „zewnętrzne” (opracowane w ramach światowej teorii i filozofii prawa) ma miejsce stosunkowo rzadko.Za konstytucyjną zasadę prawa doktryna prawa i orzecznictwo uważają zasadę odpowiedniego vacatio legis. Została ona wyprowadzona przez polski Trybunał Konstytucyjny z zasady demokratycznego państwa prawnego za pośrednictwem zasady ochrony zaufania obywateli do państwa i stanowionego przez to państwo prawa. Chociaż nie jest to zasada expressis verbis wyrażona w Konstytucji RP z dnia 2 kwietnia 1997 r., jej pozycja jako zasady konstytucyjnej nie jest kwestionowana. Zasada odpowiedniego vacatio legis spełnia wymagania stawiane przez doktrynę zasadom prawa, ma silne uzasadnienie aksjologiczne wiążące się z potrzebą zapewnienia bezpieczeństwa prawnego oraz mocne zakorzenienie w tradycji kulturowo-prawnej.

The aim of the discussion herein is to analyse the thought of Leon Petrażycki from the point of view of the role played by the category of efficiency of law law. The study confirmed the research hypothesis that the most important problems raised in Petrażycki's thought are related to the efficiency of law. The issues of law efficiency in Leon Petrażycki's work fall within the scope of legal policy, which was supposed to be the task of consciously determining the directions and goal towards which society is to be led. The main goal, with milestones (instrumental objectives) subordinated to it, is to achieve the ideal of love. For L. Petrażycki, the most important is the motivational efficiency and educational efficiency. On the other hand, the very behaviour compliant with the models included in legal norms is to serve the instrumental purposes, and the currently distinguished efficiency in a broader sense (finitistic) should be recognized taking into account the Petrażycki's ideal of love and the degree of approaching its implementation through legal regulations. Despite love being a fundamental value in human life, we, as a society, are not yet ready to enshrine this value in the Constitution, even though over a hundred years have passed since Leon Petrażycki proclaimed his ideas.

Celem podjętych rozważań jest analiza poglądów Leona Petrażyckiego z punktu widzenia roli, jaką odgrywa w nich kategoria skuteczności prawa. W opracowaniu potwierdzona została hipoteza badawcza, iż najistotniejsze problemy poruszane w myśli Petrażyckiego wiążą się właśnie ze skutecznością prawa. Problematyka skuteczności prawa u Leona Petrażyckiego mieści się, bowiem w zagadnieniach polityki prawa, na której miało spoczywać zadanie świadomego ustalenia kierunków i celu, do którego ma być prowadzone społeczeństwo. Celem naczelnym, któremu powinny być podporządkowane cele pośrednie (instrumentalne) jest osiągnięcie ideału miłości. Najważniejsze znaczenie ma dla L. Petrażyckiego skuteczność motywacyjna i skuteczność wychowawcza. Natomiast samo zachowanie zgodne w wzorami zawartymi w normach prawnych ma służyć celom instrumentalnym, zaś wyróżniana współcześnie skuteczność szerszym znaczeniu (finitystyczna) powinna być ujmowana przy uwzględnieniu petrażycjańskiego ideału miłości i stopnia zbliżania się do jego realizacji za pomocą regulacji prawnych. Chociaż miłość jest fundamentalną wartością w życiu człowieka to jednak jako społeczeństwo nie jesteśmy jeszcze gotowi zapisać tej wartości do Konstytucji, mimo iż od czasu kiedy Leon Petrażycki głosił swoje idee minęło ponad sto lat.
