The right to strike is subjected to criticism. The main argument of this institution’s opponents is, visible already, the prima facie contradiction between the social peace rule and the common good. Particularly, the datedness of this institution is pointed out as well as the existence of other alternative dispute resolution methods which could replace it successfully. For this reason, this article’s aim is an attempt to answer a research question regarding the identification of the relationship between the right to strike and the social peace rule. For this purpose, the dissertation was divided, excluding the introduction, into six parts. The first two were dedicated to the conceptualization of the right to strike notion and the social peace rule. Subsequently, in the following part of the article, these issues have been analysed from historical, axiological, and moral-ethical aspects. After making arrangements that the right to strike is not a simple denial of social peace, it has been demonstrated what the constructive function of strikes rests upon in the implementation of this rule. Then, the Author presented the conditions after fulfillment of which a strike can make a positive contribution to social peace shaping and the common good. At the end, the conclusions have been described.

Prawo do strajku jest poddawane krytyce. Głównym argumentem przeciwników tej instytucji jest – widoczna już prima facie – jego sprzeczność z zasadą pokoju społecznego i dobra wspólnego. W szczególności wskazuje się na przestarzałość tej instytucji oraz istnienie innych metod rozwiązywania sporu, które z powodzeniem mogłyby ją zastąpić. Z tego powodu celem niniejszego artykułu jest próba odpowiedzi na pytanie badawcze dotyczące określenia relacji między prawem do strajku a zasadą pokoju społecznego. W tym celu praca z wyłączeniem wstępu, została podzielona na sześć części. Pierwsze dwie zostały poświęcone konceptualizacji pojęcia prawa do strajku i zasady pokoju społecznego. Następnie w dalszej części artykułu zagadnienia te zostały poddane analizie w aspekcie historycznym, aksjologicznym i moralno-etycznym. Po dokonaniu ustaleń, że prawo do strajku nie jest prostym zaprzeczeniem pokoju społecznego, zostało wykazane, na czym polega konstruktywna funkcja strajków w realizacji tej zasady. Następnie zostały przedstawione warunki, po zrealizowaniu których strajk może mieć pozytywny wkład w kształtowanie pokoju społecznego i dobra wspólnego. Na końcu zostały przedstawione wnioski.

In the judgment of the ECtHR in the case of Association of Academics v. Iceland, the Court commented on two important issues concerning the broadly understood procedure for resolving collective disputes. Firstly, the Court pointed out that “found that the taking of industrial action should be accorded the status of an essential element of the Article 11 guarantee but it is clear that strike action is protected by Article 11 as it is considered to be a part of trade union activity”. Secondly, it considered that the institution of mandatory arbitration could be a substitute for the right to strike, which was prohibited due to the need to protect the health of Icelandic citizens. In the context of the issues outlined in this way, the aim of the gloss is to verify the two theses mentioned above. First, the thesis was analyzed according to which the right to strike is not an essential element of freedom of association. For this reason, the jurisprudence of the Tribunal has been discussed against the background of ILO standards, taking into account the doctrine’s views on the status of the right to strike in the system of human rights protection and its relationship with other irenic methods of dispute resolution. Secondly, the thesis of the ECtHR was verified, according to which the mandatory arbitration established by the Icelandic legislator in the circumstances presented in the facts of the case does not constitute a violation of the right to strike. As part of the second thesis, the concept of mandatory arbitration and its status in the jurisprudence of the Court, as well as ILO bodies and labor law doctrine were analyzed. Finally, the relationship between the right to strike and social arbitration was examined.
