Selected Issues Regarding the Normative Regulation of the Citizens’ Panel in Poland

The citizens’ panel is one of the instruments of deliberative democracy, which has been recently implemented in Poland. Its essence is manifested in the creation of a representative group of residents, which, after acquiring knowledge on a given topic, prepare recommendations constituting a solution to a given problem. The current legal solutions concerning the citizens’ panel in Poland are primarily governed by local law. They vary not only in content, but also in legal forms, initiators, methods of appointing experts and even the very concept of the “citizens’ panel”. This article attempts to show these differences in current Polish regulations. The considerations on the citizens’ panel are followed by conclusions de lege ferenda which aim to improve the current legislative solutions.

Panel obywatelski jest jednym z instrumentów demokracji deliberatywnej, który od niedawna jest wykorzystywany w Polsce. Jego istota przejawia się w utworzeniu reprezentatywnej grupy mieszkańców, która po pozyskaniu wiedzy na dany temat, stworzyłaby rekomendacje stanowiące rozwiązanie określonego problemu. Obecne rozwiązania prawne polskiego panelu obywatelskiego występują są przede wszystkim regulowane aktami prawa miejscowego. Są one zróżnicowane nie tylko co do treści, ale również form prawnych, podmiotów inicjujących, sposobu powoływania ekspertów, a nawet samego pojęcia „panelu obywatelskiego”. W niniejszym opracowaniu podjęto próbę ukazania tych różnić w dotychczasowych polskich regulacjach. Przedstawiono także wnioski de lege ferenda, mające na celu ulepszenie legislacyjnych rozwiązań.

In this article, the authors focus on showing the normative structure of the General Council of the Judiciary as a specific body aimed at protecting the independence of the courts and the independence of the judiciary. In the content of the article they analyse the principles of creation of this body, its internal organisation and competences. The main purpose of this analysis is to answer the question of whether Spanish solutions can be an inspiration to other states that want to properly protect the above values. However, the conclusions are not positive. A very narrow constitutional regulation, and thus granting of significant freedom for the legislator in shaping the General Council, causes basic weaknesses related to the functioning of a kind of “government” of judges.

Civic Budget in Elbląg. Selected Legal and Political Science Issues

The study is devoted to the presentation of the functioning of the civic budget in Elbląg from the normative and practical perspective. The authors focus on selected legal and political science issues, i.e. the initiative to submit proposals of tasks to be financed from the civic budget, the territorial and subjective scope of submitted projects and selected aspects of how this form of public consultations works in practice. The results of the research lead to the conclusion that, despite the fact that eight editions of the civic budget have already been carried out, the city has not developed an ideal model of its functioning. The biggest problems seem to be manifested in the legislative inconsistency and the weakening interest of residents.

Opracowanie skupia się na przedstawieniu funkcjonowania elbląskiego budżetu obywatelskiego w płaszczyźnie normatywnej i praktycznej. Autorzy skupili się na wybranych zagadnieniach prawnych i politologicznych, t.j.: przysługującej inicjatywie zgłaszania zadań, zakresie terytorialnym i przedmiotowym zgłaszanych projektów, a także wybranych aspektach praktyki działania tej formy konsultacji społecznych. Rezultat dokonanych badań prowadzi do wniosku, że mimo przeprowadzonych w Elblągu 8 edycji budżetu obywatelskiego, miasto nie wypracowało idealnego modelu jego funkcjonowania, a największe problemy zdają się przejawiać w niespójności legislacyjnej i słabnącym zainteresowaniu mieszkańców.
