The increasing use of artificial intelligence in employment seems inevitable. In addition to numerous benefits, it carries significant risks for employees. The authors of this article attempted to answer the question to what extent Polish labor law is ready for the challenges posed by the use of artificial intelligence in employment and what possible actions should be taken to provide employees with an adequate level of protection against potential threats that may result from the use of artificial intelligence in employment. For this purpose, the authors identified the areas where the greatest threats related to the use of artificial intelligence are perceived and analyzed the currently existing legal protection measures that can be used to guarantee this protection. Then-if it is determined that the state of this protection is insufficient-they try to formulate de lege ferenda postulates aimed at filling the gaps in this area.
On September 22, 2023, art. 7555 of the Code of Civil Procedure came into force, establishing a new means of securing the claim in the form of an obligation to continue the employment of employees particularly protected against termination of employment contract, who have filed a claim for reinstatement, until the final conclusion of the proceedings. Art. 7555 of the Code of Civil Procedure has a very specific character – both in the light of the basic principles of labor law, especially the principle of voluntary establishment of an employment relationship, and under the provisions of civil procedure, constituting a far-reaching exception to art. 731 of the Code of Civil Procedure. Due to the above, the provision raises significant doubts and concerns, especially on the part of employers. In this study, the authors conduct an in-depth analysis of Art. 7555 of the Code of Civil Procedure and attempt to evaluate the regulation.

W dniu 22 września 2023 r. wszedł w życie art. 7555 k.p.c. ustanawiający nowy środek zabezpieczający w postaci obowiązku dalszego zatrudniania pracowników szczególnie chronionych, którzy wystąpili z powództwem o przywrócenie do pracy, do dnia prawomocnego zakończenia postępowania. Art. 7555 k.p.c. ma bardzo szczególny charakter – zarówno w świetle podstawowych zasad prawa pracy, zwłaszcza zasady dobrowolności nawiązania stosunku pracy, jak i na gruncie przepisów kodeksu postępowania cywilnego, stanowiąc daleko idący wyjątek od art. 731 k.p.c. W związku z powyższym przepis budzi istotne wątpliwości i obawy, zwłaszcza po stronie pracodawców. W przedmiotowym opracowaniu autorzy dokonują pogłębionej analizy art. 7555 k.p.c. i podejmują próbę oceny regulacji.
