Mediation is an instrument of conciliatory dispute resolution, which works well in civil, criminal and administrative disputes. However, the Polish legislator didn’t provide mediation for tax procedure, although cases in the field of this procedure may be subject of mediation at the stage of proceedings before the administrative court. The possibility of using mediation in criminal-tax cases has also been excluded, although some cases related to the heaviest crimes concerning taxes may be mediated on the basis of regulations of criminal procedure. Selectively enabling the conduct of mediation in tax cases makes mediation an unused and inefficacious institution, although it has great potential to resolving tax disputes.

Mediacja stanowi narzędzie polubownego rozwiązywania sporów, które sprawdza się w sporach cywilnych, karnych i administracyjnych. Polski ustawodawca nie przewidział jednak mediacji w postępowaniu podatkowym, choć sprawy objęte tym postępowaniem mogą być poddane mediacji na etapie postępowania przed sądem administracyjnym. Wyłączono również możliwość korzystania z mediacji w sprawach karnych skarbowych, mimo że niektóre sprawy dotyczące najcięższych przestępstw związanych z podatkami mogą być mediowane na gruncie przepisów o postępowaniu karnym. Wybiórcze umożliwianie mediowania w sprawach podatkowych czyni z mediacji instytucję nieużywaną i nieskuteczną, mimo że ma ona duży potencjał, jeśli chodzi o rozwiązywanie sporów podatkowych.
