The article presents the covenant marriage on the example of the state of Louisiana. This institution is a legally distinct kind of marriage, in which the marrying couple agree to obtain pre-marital counseling and accept more limited grounds for divorce. The author attempts to answer the question about the transfer of this institution as a whole or its individual elements on the ground of Polish law. This article provides some reflection about the liberalisation of divorce law in Poland and Europe.

Celem niniejszego artykułu jest zaprezentowanie instytucji covenant marriage na przykładzie stanu Luizjana oraz próba odpowiedzi na pytanie, czy uzasadniony byłby postulat przetransponowania tej instytucji w całości lub jej poszczególnych elementów na grunt prawa polskiego. Pojawienie się instytucji covenant marriage pokazuje, że społeczeństwo amerykańskie, znane ze swojego liberalnego charakteru, zauważyło negatywne skutki zbyt daleko idącego liberalizmu prawa małżeńskiego i rozwodowego. Niniejszy artykuł stanowi pewien asumpt do rozważań na temat zasadności zahamowania tendencji liberalizacji prawa rozwodowego w Polsce i Europie.
