Court interpreters play a central and crucial role in multilingual communication between participants to the proceedings in the court room. The author points out that the interpreter is still frequently considered as a machine automatically converting a message in one language into another. The paper is devoted to the reality of court interpreting and strategies adopted by interpreters to provide successful court communication. The reasearch has been carred out in Austrian courts. It revealed that interpreters are not only intermediaries in cross-lingual and cross-cultural communication but also they often must co-ordinate court interactions. It is concluded that interpreters are active participants in court proceedings and experts in transcultural communication.

DolmetscherInnen nehmen in einem mehrsprachigen gerichtlichen Handlungskontext eine zentrale Stellung ein. Um ihre primäre Aufgabe, die Herstellung erfolgreicher Kommunikation zwischen Verfahrensbeteiligten, erfüllen zu können, benötigen sie einen breiten Handlungsspielraum. Nicht selten kommt es jedoch vor, dass InstitutionsvertreterInnen DolmetscherInnen lediglich als translatorische Maschinen betrachten, deren Anwesenheit im Gerichtssaal ignoriert werden kann. Im Fokus der vorliegenden Studie liegt die gerichtsdolmetscherische Praxis und insbesondere Handlungsstrategien, welche von aktiv tätigen DolmetscherInnen während des transkulturellen kommunikativen Handelns bei Gericht entwickelt werden. Die Analyse der Feldprotokolle von gedolmetschten Hauptverhandlungen an einem Wiener Gericht zeigt die Komplexität des translatorischen Handelns bei Gericht, das neben der Sprach- und Kulturmittlung auch die Koordination der gerichtlichen Interaktion umfasst. Die gewonnen Ergebnisse betonen die Rolle von GerichtsdolmetscherInnen als aktiven Verfahrensbeteiligten und ExpertInnen für transkulturelle Kommunikation und sollten vor allem dazu beitragen, das Bewusstsein für die Dolmetscherrolle zu steigern.

Rola tłumacza w multilingwalnym kontekście sądowym jest centralna dla powodzenia komunikacji między uczestnikami postępowania. Mimo, że zadania translatorskie w sądzie wymagają szerokiej swobody działania, przedstawiciele instytucji nierzadko postrzegają tłumacza jako automatycznie działającą maszynę, której obecność może być ignorowana. Niniejszy artykuł poświęcony jest rzeczywistości tłumaczenia na sali sądowej, a przede wszystkim strategiom, jakie podejmują praktykujący tłumacze w ramach komunikacyjnych działań transkulturowych w sądzie. Wyniki obserwacji postępowań karnych z udziałem tłumaczy w austriackim sądzie ukazują kompleksowość roli i zadań tłumacza sądowego, które obejmują nie tylko pośrednictwo językowe i kulturowe, ale również koordynację interakcji sądowej. Wyniki analizy podkreślają szczególną rolę tłumacza jako aktywnego uczestnika procesu oraz eksperta od komunikacji transkulturowej i tym samym przyczyniają się do budowania świadomości odnośnie roli tłumaczy sądowych.

Complying with the rules of professional ethics during court interpreting is one of the most significant aspects of the court interpreter’s profession. Although associations of translators and interpreters draw up sets of rules in the form of professional codes, most of the practicing translators are not well acquainted with them, especially as the curricula of translation studies do not include ethics. The aim of this article is to present how the prescriptive norms of professional conduct can be applied in practice during court interpreting. The interpreters’ performance is discussed in view of their adherence to the principle of impartiality, on the example of the interpreted criminal proceedings in the Austrian court. The analysis reveals that court interpreters tend to violate this principle, by modifying the interpreted statements, lack of loyalty to the speaker, showing emotions or by assuming the role of a judge’s helper. The research further shows that the prescriptive rules are not always congruent with reality, as the ethical performance of the interpreter is often determined by the expectations of the other participants of the procedure. Due to the above, it seems vital to draw the attention of both the court interpreters and the representatives of the legal profession to the ethical aspect of court interpreting.

Die Einhaltung berufsethischer Normen durch GerichtsdolmetscherInnen im Verhandlungssaal ist einer der zentralen Aspekte der professionellen Berufsausübung. Interessensvertretungen arbeiten zwar entsprechende Regeln in Form von Ehren- und Berufskodizes aus, deren Kenntnis unter praktizierenden GerichtsdolmetscherInnen scheint jedoch fraglich zu sein, zumal Studiencurricula der Dolmetscherausbildung keine Berufsethik-Module beinhalten. Der vorliegende Beitrag erklärt, inwiefern präskriptive Verhaltensregeln in der gerichtsdolmetscherischen Praxis zur Anwendung kommen. Am Beispiel gedolmetschter strafrechtlicher Hauptverhandlungen an einem Wiener Gericht wird das translatorische Handeln von DolmetscherInnen hinsichtlich der Einhaltung des Unparteilichkeitsgrundsatzes diskutiert. Die Analyse zeigt, dass GerichtsdolmetscherInnen gegen das Prinzip auf unterschiedliche Weise verstoßen, sei es durch das eigenständige Eingreifen in gedolmetschte Aussagen, die mangelnde Loyalität dem Sprecher gegenüber, gezeigte Gefühle oder durch die Übernahme der Funktion eines Gerichtshelfers. Weiters ergibt die Studie, dass präskriptive Berufsnormen der gerichtsdolmetscherischen Wirklichkeit oft nicht standhalten können, da das ethische Handeln von DolmetscherInnen nicht selten das Resultat von Erwartungshaltungen anderer InteraktionspartnerInnen an die dolmetschende Person ist. Es scheint daher notwendig, sowohl praktizierende GerichtsdolmetscherInnen, als auch juristisch Handelnde auf den ethischen Aspekt der gerichtsdolmetscherischen Tätigkeit aufmerksam zu machen.

Przestrzeganie zasad etyki zawodowej przez tłumaczy na sali rozpraw jest jednym z ważniejszych aspektów pracy profesjonalnego tłumacza sądowego. Organizacje zrzeszające tłumaczy opracowują wprawdzie zbiory norm ujęte w kodeksy zawodowe, ich znajomość wśród praktykujących tłumaczy wydaje się jednak wątpliwa, zwłaszcza że programy studiów kształcących tłumaczy nie zawierają przedmiotów z zakresu etyki. Niniejszy artykuł wyjaśnia zatem, w jakim stopniu preskryptywne normy profesjonalnego zachowania znajdują zastosowanie w praktyce tłumaczenia sądowego. Na przykładzie tłumaczonych postępowań karnych w austriackim sądzie omawiane jest działanie tłumaczy pod kątem zachowania przez nich zasady bezstronności. Analiza pokazuje, że tłumacze sądowi w różny sposób naruszają tę zasadę, czy to przez ingerencję w tłumaczone wypowiedzi, brak lojalności wobec mówcy, okazywanie emocji, czy też przejmowanie funkcji pomocnika sędziego. Z badań wynika ponadto, że preskryptywne normy nie zawsze przystają do realiów sali rozpraw, ponieważ etyczne działanie tłumacza nierzadko jest wypadkową oczekiwań pozostałych uczestników interakcji wobec tłumacza. Dlatego niezbędne wydaje się zwrócenie uwagi, zarówno samych tłumaczy sądowych, jak i środowiska prawniczego na etyczny aspekt pracy tłumaczy w sądzie.
