Modern collection of information from open sources like state, press and private ones come under open-source intelligence and it is a complement to operation activities carried out in criminology. The article focuses on working out personal and capital relationships by means of open-source intelligence and on obtaining data from open sources as a complement to the information which will help reveal personal relationships or motives for the crime after years. The article discusses universally available sources like state registers, private sources of information, sources of political information and motives of business entities recognition i.e. tortious motives in economic crime and in criminal offences as well as in industrial espionage and sabotage.

Współczesne pozyskiwanie informacji ze źródeł jawnych – państwowych, prasowych i prywatnych – należy do białego wywiadu i jest ono dopełnieniem wykonywanych czynności operacyjnych w kryminalistyce. W artykule zwrócono uwagę na sposoby rozpracowania powiązań osobowych i kapitałowych za pomocą białego wywiadu, a także możliwość pozyskania danych z otwartych źródeł jako uzupełnienie informacji, które będą pomocne w ujawnieniu po latach powiązań osobowych czy motywów zbrodni. W artykule omówione zostały źródła powszechnie dostępne: rejestry państwowe, prywatne źródła informacji, źródła informacji politycznej, jak również rozpoznawania podmiotów gospodarczych, tj. motywy deliktowe w przestępczości gospodarczej i kryminalnej, szpiegostwie przemysłowym oraz sabotażu.

One of the most basic functions of the state is to ensure the security to it and its citizens. Significant elements are: perseverance, political independence, territorial integrity and maintenance proper level of life quality. Today’s intelligence, which is part of the structures of security organs, belongs to the elite part of the special forces performing strategic goals. Therefore, acquiring the information by OSINT is important not only for the institution itself but also for citizens. OSINT is one of the means by which security is provided to the internal and external states. Open source information is one of the agents of economic, political, military, etc. Books, periodicals, statistical yearbooks, social networking sites and daily newspapers belong to the basic, verified sources. In globalized world, OSINT has particular importance because, due to the obtained information, the state can take defensive action. In this article, the author pointed out the use of OSINT in the military diagnosis.

This study is devoted to the issue of the legal limitation of the entrepreneur’s ability to run a business. The study attempts to show what economic activity is, what is its scope and subject matter, and what may be the consequences of the prohibition of conducting business activity against an entrepreneur who is respectively: a natural person, a legal person or an organizational unit without legal personality, and having legal capacity. Depending on the legal status of the entrepreneur, the adjudicated ban on running a business (irrespective of its basis) may give rise to various consequences of an existential nature of the entrepreneur.

Niniejszy artykuł dotyczy zagadnienia prawnej limitacji możliwości prowadzenia działalności gospodarczej przez przedsiębiorcę. W opracowaniu starano się przybliżyć, czym jest działalność gospodarcza, jaki jest jej zakres przedmiotowy i podmiotowy, a także jakie mogą być konsekwencje orzeczenia zakazu prowadzenia działalności gospodarczej względem przedsiębiorcy, który jest odpowiednio: osobą fizyczną, osobą prawną lub jednostką organizacyjną nieposiadającą osobowości prawnej, a mającą zdolność do czynności prawnej. W zależności od statusu prawnego przedsiębiorcy, orzeczony zakaz prowadzenia działalności gospodarczej (bez względu na jego podstawę zastosowania) może rodzić różne konsekwencje natury egzystencjalnej po stronie przedsiębiorcy.
