Building an effective migration policy is one of the greatest challenges for the European Union. It aims to effectively manage migratory flows while eliminating illegal migration and respecting human rights. The first attempts to legally regulate this issue, at the Community level, were made as early as 1985. While the Treaty of Amsterdam of 1997 made the asylum, visa, and immigration policy more common, it was only the Treaty of Lisbon that gave them their present form and expanded the competencies of the European Union in this area. Additionally, it improved the coordination of undertaken tasks and strengthened the protection of third-country nationals. The real test for the EU migration policy was the migration crisis on our continent, resulting from the Arab Spring. As recent years have shown, the mechanisms developed have not worked, and the principles of solidarity and fair sharing of responsibility between the Member States have largely remained as dead treaty provisions.

Budowa efektywnej polityki migracyjnej jest jednym z największych wyzwań Unii Europejskiej. Jej celem jest skuteczne zarządzanie ruchami migracyjnymi przy jednoczesnym niwelowaniu nielegalnej migracji i poszanowaniu praw człowieka. Pierwsze próby prawnego uregulowania tej kwestii na szczeblu wspólnotowym podjęto już w 1985 r. O ile Traktat amsterdamski z 1997 r. dokonał uwspólnotowienia polityki azylowej, wizowej i migracyjnej, o tyle dopiero Traktat z Lizbony nadał im dzisiejszą formę i rozszerzył kompetencje Unii Europejskiej w tym zakresie. Dodatkowo poprawił on koordynację podejmowanych zadań i wzmocnił ochronę obywateli państw trzecich. Prawdziwym sprawdzianem dla unijnej polityki migracyjnej był kryzys migracyjny na naszym kontynencie, będący efektem Arabskiej Wiosny. Jak pokazały ostatnie lata, wypracowane mechanizmy nie zdały egzaminu, a zasady solidarności i sprawiedliwego podziału odpowiedzialności między państwami członkowskimi w dużym stopniu pozostały martwymi przepisami traktatowymi.
