The gloss to the of the Judgment of Seven Judges of the Supreme Court of 19th February 2013 (III CZP 63/12) on the application of the art. 433 of the Polish Civil Code to liability for the loss resulting from flooding a flat from another flat located above it

According to the Glossed Judgment art. 433 does not comprise the situation when a room is overflowed by water leaking through the ceiling from another room situated above. The judgment says that in such a situation a perpetrator is liable on general basis which means that the aggrieved person has to prove negligence. The authors do not agree with the Judgment arguing that the Supreme Court's argumentation is based on the historical interpretation of the ancient Roman actio de effusis et deiectis which is no longer up to date with modern circumstances when most flats are furnished with running water and sewer systems. According to the authors the art. 433 of the Civil Code, when interpreted according to the Supreme Court’s Judgment, loses its significance.

The subject of gloss on the judgment of the Supreme Administrative Court, ref. II OSK 1698/12, includes the issue of establishing a party in the proceedings for the annulment of the decision on the use permit for a building. In the opinion of the Supreme Administrative Court, the procedure of extraordinary proceedings, in this case, cannot be limited only to the possibility of the investor initiating proceedings.

The body serves as a boundary between the subject and the object. Things, including those used by a human being, always differ in terms of their legal status from that of a human being. The living organism of homo sapiens is a natural person; the subject that is in certain relations with things outside it but is not in an ownership relation with itself. Nevertheless, how to assess objects permanently connected to the body? Do they become part of the body, and consequently an element of the subject, or do they still remain things whose status can be assessed according to regulations applicable to things? Or maybe their status is distinct, in between the object and the subject? Perhaps answers to these questions necessitate the modification of the paradigm according to which the body delimits the subject’s boundary. The subject may reach beyond the body, but it can also encompass artificial objects, including but not limited to those that have been connected to the body.

Ciało stanowi granicę między podmiotem i przedmiotem. Rzeczy, również te, którymi posługuje się człowiek, mają zawsze inny status prawny niż człowiek. Żywy organizm homo sapiens jest osobą fizyczną, podmiotem, który jest w określonych relacjach do tego, co się znajduje poza nim, natomiast nie jest w relacji właścicielskiej z samym sobą. Jak ocenić jednak przedmioty połączone trwale z ciałem? Czy stają się one częścią ciała a zatem składową podmiotu, czy też pozostają nadal rzeczami, których status można oceniać według regulacji właściwych rzeczom? A może ich status jest jakiś inny, pośredni między przedmiotem a podmiotem? Być może odpowiedzi na te pytania wymagają zmiany paradygmatu, zgodnie z którym ciało jest granicą podmiotu. Podmiot może sięgać poza ciało, ale może obejmować też przedmioty sztuczne, również, ale nie tylko te, które zostały z ciałem połączone.
