Celem artykułu jest przedstawienie orzecznictwa SN w sprawach o podział majątku wspólnego małżonków po ustaniu wspólności ustawowej. Jak pokazuje praktyka coraz więcej spraw z tego zakresu trafia na wokandy sądowe. Autorka w rozważaniach teoretycznych dokonuje analizy uregulowań dotyczących omawianej problematyki, z uwzględnieniem rozliczeń między małżonkami z tytułu wydatków i nakładów poczynionych z majątku wspólnego na majątki osobiste każdego z małżonków i odwrotnie. Kluczowym zagadnieniem w tych sprawach jest problematyka podziału majątku, w skład którego wchodzi nieruchomość (lokal mieszkalny czy użytkowy, budynek) obciążona hipoteką przewyższającą aktualną wartość rynkową tej nieruchomości. Niestety, w tej kwestii nie wypowiedział się jeszcze SN. Autorka wysuwa propozycje, co do sposobu dokonania podziału majątku z takim obciążeniem hipotecznym.

The purpose of the article is presentation of the Supreme Court case-law in relation to the division of the joint property of spouses after standing still of the community property. It is known from experience that more and more cases of this kind are brought before the courts. Author`s theoretical deliberation analyses this issue, especially the problem of a payoff between spouses, relating from expenses and imput on personal and joint properties of spouses. The key issue in such cases is the partition of joint property including a mortgage on a real estate ( a residential premisses, a business premisses, a building), especially in cases in which a value of the mortgage is higher then a current value of the estate. Unfortunately, there is no judgement of the Supreme Court relating to this issue. The author makes suggestions as to the possible way of the partition of the mortgaged joint marital property.
