The article characterises the institution of mediation, which has been introduced into general administrative proceedings. Currently it can be conducted not only between parties with conflicting interests but also between the authority conducting the proceedings and the parties to these proceedings. Mediation is conducted by a mediator who seeks to resolve a dispute amicably. The supposed benefits of mediation include, among others: a significant reduction of the time of proceedings, making the proceedings more informal and flexible and a greater interest of the disputing parties themselves in working on the outcome of the case. As a result of the spread and consolidation of mediation in Polish administrative proceedings, it is possible that the introduction of a new understanding of the role of administrative proceedings, a change in the style of administration taking place when cases are settled and a change in the position of the individual in relations with public institutions will become a reality.

W artykule scharakteryzowano instytucję mediacji, która została wprowadzona do postępowania administracyjnego ogólnego. Aktualnie może być prowadzona nie tylko pomiędzy stronami o sprzecznych interesach, ale również pomiędzy organem prowadzącym postępowanie i stronami tego postępowania. Mediacja jest prowadzona przez mediatora, który dąży do polubownego rozwiązania sporu. Przypuszczalnymi korzyściami płynącymi z mediacji są m. in.: znaczne skrócenie czasu postępowania, odformalizowanie i uelastycznienie postępowania oraz większe zainteresowanie samych stron sporu pracami nad wynikiem sprawy. W wyniku upowszechnienia oraz ugruntowania się mediacji w polskim postępowaniu administracyjnym, być może, realnym stanie się wprowadzenie nowego rozumienia roli postępowania administracyjnego, zmiana stylu administrowania zachodzącego podczas załatwiania spraw oraz zmiana pozycji jednostki w stosunkach z instytucjami publicznymi.

Nowadays, effective protection of personal data is one of the fundamental issues of a democratic state under the rule of law. Therefore, the legislator should be very precise about the principles and standards of data processing. In the last few decades, in particular, the development of new technologies, digitalisation and the increase in the need for electronic communication has become evident, which leads to the adoption of appropriate regulations for the handling of personal data. In addition, the EU legislator has introduced the General Data Protection Regulation (GDPR) in order to harmonise the regulations of EU Member States regarding the protection of personal data. This provides a framework for the proper functioning of legal provisions across the European Union regarding the handling of personal data of its citizens.The aim of the article is to identify the legal changes resulting from the Personal Data Protection Regulation, with a particular focus on the persons to which they apply and then to analyse the regulation of ‘the right to be forgotten’. In the first part of the article, attention is drawn to the way personal data are processed and the scope of obligations incumbent on data controllers. This is because data controllers are, together with the personal data protection officer, responsible for recording data processing activities, including ongoing monitoring and responding to situations of inaccurate data processing. The second part focuses on the right to be forgotten and the assessment of this entitlement in the perspective of Regulation 2016/679. The research methods include an analysis of legal acts, at the same time using the subject literature.

Mediation was introduced into general administrative proceedings by the Act of 7 April 2017 amending the Act - Code of Administrative Procedure and certain other acts, and was finally regulated in Chapter 5a of Section II of the CAP. At present, public administration bodies, in cases whose nature allows to do so, seek amicable settlements of disputed issues and aim to determine the rights and obligations which are the subject of the proceedings, in matters within their jurisdiction, in particular, by taking actions necessary for mediation. Mediation as a way  of settling administrative law cases is not developing  as dynamically in Polish practice as the legislator expected. One of the reasons for this state of affairs is the lack of a clear definition of the catalogue of cases   in which mediation is possible and justified. At the same time, administrative mediation is not a legally unlimited construction. Its use has been limited by  the legislator through prerequisites, i.e. legal requirements on which its legal admissibility depends. The key in this respect was to determine the prospects for concluding mediation in the mode specified in Article 96a § 3 of the CAP, i.e. by issuing a decision acceptable to the parties to the proceedings or concluding an administrative settlement. The study attempted to apply various criteria, such as the ways in which the proceedings were initiated, their subject matter, the state of progress of the investigation and the different categories of participants. On the basis of these, the ‘mediation potential’ of administrative cases was sought.
