The principle of cumulation in the inheritance and donation tax, as a legal concept, is an institution with a hundred-year history. Due to law changes and changes in law structure, proper interpretation is very difficult. Obeying the literal interpretation border necessarily leads to an unacceptable result. The solution ensuring the proper functioning of the cumulation rule is to transgress the limits of linguistic interpretation, so that the result of the interpretation would be in accordance with the deep structure of the tax act. In breaking the language border, a specific method of law interpretation can be helpful, method thats taking into account contextualism as well as the coherence of law and the legal and economic structure.

Zasada kumulacji w podatku od spadków i darowizn jest, jako koncepcja prawna, instytucją o stuletniej historii. Ze względu na zmiany o charakterze legislacyjno-systemowym interpretacja przepisów ustanawiających jej byt prawny napotyka na duże trudności. Traktowanie granicy wykładni językowej bezwzględnie prowadzi do niemożliwego do zaakceptowania rezultatu. Rozwiązaniem zapewniającym prawidłowe funkcjonowanie zasady kumulacji jest wykroczenie poza granicę językową wykładni, tak by wynik wykładni pozostawał w zgodzie z głęboką strukturą ustawy podatkowej. W przełamaniu granicy językowej może pomóc metoda wykładni prawa uwzględniająca problem kontekstualizmu oraz koherencję prawa i struktury prawno-ekonomiczne związane z ustawą podatkową.

‘Activities which cannot be governed by a legally binding contract’ is a term found exclusively in the realm of tax law with no definite set of referents appended to it by the lawmakers. The term corresponds to constructs existing in other departments of law and has been in use for over 20 years, but it does give many interpretation problems. For all the homoeostatic objectives of the tax law, the changing socially acceptable values are causing change in the range of referents of the term in question. This problem requires detailed study.

We have been looking for answers to the question: what is law and what is its relation to morality for several thousand years. It seems that the definitions and analyzes created so far are still insufficient. A look at the past proves that we are developing the law in this area, generally pushed to it by some tragic events that affect not only law but also universal culture. On the other hand, it is the broadly understood culture that shapes certain patterns of desired behavior much stronger than the law. Shaping the mutual relations between law, morality and pop culture should be the subject of reflection and scientific research. It seems that we are stuck in a certain stagnation, in a deadlock in the development of law, which started in the first half of the 20th century. History proves that we will be stuck in it at least until the next terrible event that will shock the international community, change the perspective and trigger a domino of change.

Na pytanie, czym jest prawo i jaki jest jego stosunek do moralności poszukujemy odpowiedzi od kilku tysięcy lat. Wydaje się, że powstałe dotąd definicje i analizy nadal są niewystarczające. Spojrzenie w przeszłość dowodzi, że rozwijamy prawo w tym zakresie na ogół pchnięci do tego jakimiś tragicznymi wydarzeniami, które oddziaływają nie tylko na prawo, ale i na kulturę powszechną. Z drugiej strony to właśnie szeroko rozumiana kultura kształtuje pewne wzorce powinnych zachowań o wiele silniej niż prawo. Kształtowanie wzajemnych relacji pomiędzy prawem, moralnością a popkulturą winno być przedmiotem refleksji i pogłębionych badań naukowych. Wydaje się, że tkwimy w pewnej stagnacji, w martwym punkcie rozwoju prawa, w który trafiliśmy w pierwszej połowie XX wieku. Historia dowodzi, że będziemy w nim tkwić co najmniej do czasu kolejnego strasznego wydarzenia, które wstrząśnie społecznością międzynarodową, zmieni perspektywę i uruchomi domino zmian.
