The aim of this article is to present the liability of Russia and Ukraine regarding Crimea under the European Convention on the Protection of Human Rights. The author analyzes pending and possible prospective cases originating from the conflict around Crimea between Ukraine and Russia. Due to the inconsistency in case law of the EC-tHR it is difficult to clearly determine what state will be considered responsible for the violation of the rights of residents of Crimea resulting from the Convention. In author’s opinion the ECtHR could determine that the Russian Federation may be held respon-sible, as well as Ukraine. However, as it seems, the liability of Ukraine will be limited to the positive obligations under the ECHR.

On March 18 2014, the Republic of Crimea became a federal subject of the Russian Federation and the Ukrainian legal system was changed to the Russian system. The transition period was set to end on January 1 2015. This transition period was characterized by the fact that the law was created on a day-to-day basis, and as the residents of Crimea were unfamiliar with Russian law they found themselves in a legal vacuum. Laws were adopted in an urgent manner to ensure that the unification was as smooth as possible. In practice it became apparent that the allocated time was not sufficient, and the transition period was extended in some areas. The Article presents a review of the accession procedure and the legal regulations established in the Republic of Crimea during the transition period, and identifies some issues which have arisen.

Pod koniec XX wieka świat na szeroką skalę zetknął się z pojęciem "państw nieuznawanych", czyli z jednostkami geopolitycznymi mającymi cechy państwa, jednak nieuznawanymi przez społeczność międzynarodową. Istnienie tych jednostek wpływa zarówno na stosunki polityczne, jak i gospodarcze na świecie. Zamiarem autorki było pokazanie na przykładzie jednego z "państw nieuznawanych" ‒ Naddniestrza, procesu stanowienia oraz funkcjonowania gospodarki takich jednostek oraz stosunków z państwami sąsiadującymi. Nieuznawanie przez inne państwa takich jednostek nie sprzyja ich rozwojowi ekonomicznemu i społecznemu.

At the end of the XX century the world has challenged on a large scale the issue of "unrecognized states", which means the geo-political units having the characteristics of states, however, not being recognized by the international community. The existence of these entities has influenced both the political and economic relations in the world. The intention of the author was to show the process of maturing of the economy of those entities and their economic relations with its neighbours basing on the example of one of the "non-recognised states"—the Transnistria region. Non-recognition of such entities by other countries is not productive to their economic and social development.
