This article is a critical gloss to the order of the Supreme Court of 25 June 2020, by which the Court in question refused to decide on the following legal question: “Can the victim, who is a minor, be represented by one of the parents in cases where the offence of non-alimony takes place and the accused is the other parent, or should a guardian be appointed for such a minor?”. The text examines the above issue on several levels. The first part of the article presents the factual and legal background of the present case, namely the proceedings before the court of first instance, the legal question posed and the decision of the Supreme Court resulting from the said legal question. The second part contains the author’s own substantive comments on what a legal act is within the meaning of family law, the regulation of Articles 98 and 99 of the Family and Guardianship Code and Article 51 Section 2 of the Code of Penal Procedure. Niniejsza glosa jest glosą krytyczną do postanowienia Sądu Najwyższego z 25 czerwca 2020 r., którym ten naczelny polski organ władzy sądowniczej odmówił podjęcia uchwały na pytanie prawne: „Czy w sprawach o przestępstwo niealimentacji pokrzywdzony, którym jest małoletni, może być reprezentowany przez jednego z rodziców, gdy oskarżonym jest drugi z rodziców, czy też dla takiego małoletniego winien być powołany kurator?”. W tekście przeanalizowano powyższe zagadnienie na kilku płaszczyznach. W pierwszej części artykułu przedstawiony został stan faktyczny i prawny niniejszej sprawy, a to postępowanie przed sądem pierwszej instancji, postawione pytanie prawne oraz postanowienie Sądu Najwyższego będące konsekwencją postawionego pytania prawnego. Druga część zawiera własne uwagi merytoryczne dotyczące tego, czym jest czynność prawna w rozumieniu przepisów prawa rodzinnego, regulacji art. 98 i 99 k.r.o. oraz art. 51 § 2 k.p.k. Ostatnia część opracowania stanowi krótkie podsumowanie rozważań.
