The author has presented different conception of dualistic divide on causation and non-causation legal actions. The analyses focuses on need to abandon that dualistic divide. The main argument is ambiguity word of causae. Author’s view is based on polish conventional legal actions theory. It professes that each legal action has got constructional and consequential principles, which are sufficient to describe consideration of them.

In the article, the author questions the justification of liability for damages by means of a repressive function. It indicates that over the years, in both the systemic and comparative aspects, "punishing" the perpetrators of damages has been replaced by the mechanism of compensation of damages. This conclusion highlights the change in the perception of basic concepts of liability for damages such as "fault" or "non - pecuniary loss".

Autor podaje w wątpliwość uzasadnianie odpowiedzialności odszkodowawczej za pomocą funkcji represyjnej. Wskazuje, że na przestrzeni lat zarówno w aspekcie systemowym, jak i komparatystycznym „karanie” sprawców szkód zastąpił mechanizm kompensacji uszczerbków. Wniosek ten uwidacznia zmiana w postrzeganiu podstawowych pojęć z zakresu odpowiedzialności odszkodowawczej takich jak „wina” czy „zadośćuczynienie pieniężne”.
