The draft Directive harmonizes on the EU level, rules of public procurement by contracting entities operating in the field of water, energy, transport and postal services. The proposed directive document, being a draft legislative act, beyond the exclusive powers of the Union, shall be assessed for compliance with the principle of subsidiarity. Such assessment may be given by national parliaments in accordance with Article 6 of the Protocol (No. 2) on the application of the principles of subsidiarity and proportionality.
