The introduction of the new regulations limiting the sale of the agricultural land from the  Agricultural Property Stock of the State Treasury is aimed at counteracting the non-agricultural use of agricultural land. New regulation can raise questions, i.e. as to moratorium concerning the sale of land. New rules of tender and new restrictions concerning land area procured from the Agricultural Property Stock of the State Treasury are described. This article also discusses issues regarding legal consequences of the violation of new regulations. Also, new contractual obligations of the buyers of the state agricultural property need to be described.

Wprowadzenie nowych przepisów ograniczających sprzedaż nieruchomości z Zasobu Własności Rolnej Skarbu Państwa ma przeciwdziałać nierolniczemu wykorzystywaniu gruntów rolnych. Nowa regulacja może jednak budzić wątpliwości interpretacyjne, zwłaszcza jeżeli chodzi o zakres moratorium na sprzedaż nieruchomości. Wskazywane są nowe reguły przetargu oraz nowy kształt ograniczeń w zakresie areału nieruchomości nabywanych od Agencji Nieruchomości Rolnych. Artykuł porusza także kwestie konsekwencji naruszenia regulacji ustawowej. Opisania wymaga dodatkowo kształt nowych obowiązków umownych nakładanych na nabywców państwowych nieruchomości rolnych.

The aim of the article is to present the pre-emptive right in the acquisition of land from the agricultural resources owned by the State Treasury in light of the amendments introduced by the Act of 5 August 2015 on the Shaping of the Agricultural Regime. The amendments deprive former owners of agricultural and their heirs of the right of first re-fusal. A prohibition to sell or establish a mortgage on purchased land is also introduced. Another novelty is a prohibition to engage in agricultural activity conducted in person on the purchased land. The new Act obliges the seller to invite tenders in a limited invitation to buy if the land in question belongs to the Resources of the State Treasury and where a transaction has been completed in breach of the provisions of this Act, it must be de-clared invalid. The concluding statement is that the amendments being introduced by the said Act have a considerable impact not only on the exercise of the pre-emptive right, but the fundamental rules of trading in state agricultural land as well.

L’obiettivo dell’articolo è di presentare l’istituto di priorità di acquisto dei fondi facenti parte dell’Agenzia fondiaria agricola Tesoro di Stato alla luce di cambiamenti introdotti dalla legge del 5 agosto 2015 sulla configurazione dell’ordinamento agrario. I cambiamenti consistono tra l’altro nel revocare il diritto di priorità agli ex proprietari e ai loro eredi. Viene introdotto il divieto contrattuale di vendere il fondo acquistato oppure di accendere un’ipoteca. Un’altra novità è l’imposizione di svolgere attività agricola in forma privata sul fondo acquistato. La nuova legge introduce l’obbligo di pubblicare bandi di gara con procedura ristretta in caso di vendita di fondi agricoli facenti parte dell’Agenzia fondiaria agricola Tesoro di Stato, ed anche una sanzione che prevede l’invalidità del negozio giuridico in caso vengano violate le norme di legge. È fondato affermare che i cambiamenti introdotti influenzino notevolmente non solo il diritto di priorità, ma anche le regole di base nell’ambito della compravendita dei fondi agricoli statali.
