„Lex deweloper” – funkcjonowanie ustawy mieszkaniowej w województwie mazowieckim w latach 2018–2023

The article discusses the impact of the Act on Facilitating the Preparation and Implementation of Housing Investments and Accompanying Investments on spatial planning in the Mazowieckie Voivodeship in the years 2018–2023, i.e. in less than 6 years of its applicability. The circumstances of the creation of the act, its basic goals and the changes introduced during its applicability are indicated. The role of the voivodeship self-government in assessing applications to determine the location of a housing investment was also discussed. The study analysed applications to determine the location of housing investments and accompanying investments (161 applications regarding 123 locations) filed with the Marshal and Executive Board of the Mazowieckie Voivodeship, and resolutions (123, including 16 refusals) regarding the determination of locations for housing investments and accompanying investments, announced in the Official Journal of the Mazowieckie Voivodeship, as well as supervisory decisions of the Mazowiecki Governor (16), declaring the above-mentioned resolutions invalid.

W artykule omówiono wpływ ustawy o ułatwieniach w przygotowaniu i realizacji inwestycji mieszkaniowych oraz inwestycji towarzyszących na planowanie przestrzenne w województwie mazowieckim w latach 2018–2023, czyli w ciągu niespełna 6 lat jej funkcjonowania. Wskazano okoliczności powstania ustawy, podstawowe cele i wprowadzone zmiany w ciągu jej obowiązywania. Została omówiona również rola samorządu województwa w opiniowaniu wniosków o ustalenie lokalizacji inwestycji mieszkaniowej. W opracowaniu przeanalizowane zostały wnioski o ustalenie lokalizacji inwestycji mieszkaniowych i inwestycji towarzyszących (161 wniosków dotyczących 123 lokalizacji) wpływające do Marszałka i Zarządu Województwa Mazowieckiego oraz uchwały (123, w tym 16 odmownych) w sprawie ustalenia lokalizacji inwestycji mieszkaniowych i inwestycji towarzyszących ogłoszone w Dzienniku Urzędowym Województwa Mazowieckiego, a także rozstrzygnięcia nadzorcze Wojewody Mazowieckiego (16) stwierdzające nieważność ww. uchwał.
