THE LEGAL NATURE OF PROFESSIONAL LIABILITY IN THE CONSTRUCTION INDUSTRY Summary The article concerns the legal nature of professional liability in the construction industry (Articles 95-101 of Ustawa z dnia 7 lipca 1994 r. – Prawo budowlane: the Polish Construction Act of July 7, 1994; Dz.U. 2013, Item. 1409; with later amendments; hereinafter P.b.). This issue requires an analysis of the relevant norms of P.b. in the context of the typical characteristics of administrative and disciplinary liability. It can be concluded that the professional liability of persons performing independent technical duties in the construction industry has a specific character, combining elements of administrative law with the solutions adopted for disciplinary penalties. The function of this liability and its essential procedural regulations, which are subject to the Polish Administrative Procedure Code (Kodeks postępowania administracyjnego) suggest its nature is administrative. However, a number of specific regulations have been drawn from the model applicable in disciplinary liability (including the deciding authority, the initiator of the proceedings, the prosecutor’s function, moderation of penalties, the catalogue of penalties, the institution of limitation of proceedings, entry of records in the register of sentenced persons and its erasure). As a result, we can formulate an objection of incoherent regulation.

Artykuł dotyczy istoty, roli i katalogu wartości w prawie administracyjnym. Zrekonstruowano w nim znaczenie podstawowych pojęć związanych z aksjologią wskazanej gałęzi prawa, zasygnalizowano konstrukcje prawne będące źródłami odkodowania wartości administracyjnoprawnych oraz dokonano klasyfikacji tych wartości według przyjętych kryteriów porządkujących. Ponadto zwrócono uwagę na relacje występujące między poszczególnymi wartościami regulacji administracyjnoprawnej oraz mechanizmy rozstrzygania kolizji między nimi.

This article addresses the nature, role, and catalogue of values in administrative law. I present a reconstruction of the basic concepts associated with this branch of the law; I describe the legal constructions which are the sources for the decoding of the values in administrative law; and I classify these values according to a set of criteria I have adopted. In addition I remark on the relations between particular values in the provisions of administrative law and the mechanisms to be applied to resolve collisions in the event of conflicting values.

The article is an attempt to examine what meaning is attributed by the Constitutional Tribunal to the concept of judgment on the basis of Article 79 (1) of the Constitution. The content of the so reconstructed definitions has been referred to those attributes which, in terms of the doctrine of administrative law, are typical of material and technical actions of public administration authorities. As a result of this comparison, it is concluded that the basic criteria for clarification by the Court of the term "judgment" (induction of direct or indirect legal effects, the result of application of a legal norm, the imperious character) are also applicable to the material and technical activities. Therefore, the arguments used by the Polish constitutional court, which are assumed to justify the exclusion of those actions from the scope of Article 79 (1) of the Constitution, are not sufficient. Their validity may be undermined by the counterarguments raised by the legal doctrine of administrative law. Accordingly, it is proposed to use such a criterion which leaves no doubt that a material-technical action by an authority is not a judgment within the meaning of Article 79 (1) of the Constitution.
