This study is a summary of the provisions of European Union law and national law regard-ing the participation of EU citizens taking advantage of the free movement of persons in elec-tions. The article analyzes legal solutions in the field of active and passive electoral law for the European Parliament and in local elections. In addition, the study indicates to what extent the applicable legal regulations fulfill their function and safeguard the interests of an EU citizen under Polish electoral law.

Niniejsze opracowanie dotyczy przepisów prawa Unii Europejskiej oraz prawa krajowego w zakresie udziału w wyborach obywateli Unii Europejskiej korzystających ze swobody przepływu osób. W artykule zostały poddane analizie rozwiązania prawne w zakresie czynnego i biernego prawa wyborczego do Parlamentu Europejskiego oraz w wyborach lokalnych. Ponadto w ramach opracowania wskazano w jakim zakresie obowiązujące regulacje prawne spełniają swoją funkcję i zabezpieczają interesy obywatela UE w ramach polskiego prawa wyborczego.
