The need for adequate protection for same-sex couples has been discussed in the case law of the ECtHR for many years. In 2023, the ECtHR gave several judgments on this issue (Fedotova and Others v. Russian Federation, Buhuceanu and Others v. Romania, Koilova and Babulkova v. Bulgaria), including its first one in that respect regarding Poland – the judgment of 12 December 2023 in the case of Przybyszewska and Others v. Poland. The purpose of this article is to outline the standard arising from the judgment as well as the implications of that ruling and selected problems related to the implementation thereof.
