The subject of this article is the prohibition of excessive delay in payment introduced as of 1 January 2020 to the Act of 8 March 2013 on payment deadlines in commercial transactions (after amendment - the Act on combating late payment in commercial transactions). The author analyzes the sources of justification for this prohibition as well as the subjective and objective scope of it. The purpose of this paper is to determine whether the legal structure of the prohibition may allow to achieve the intention, which is to combat late payment in commercial transactions.

Przedmiotem artykułu jest zakaz nadmiernego opóźniania się ze spełnianiem świadczeń pieniężnych wprowadzony 1.01.2020 r. do ustawy z 8.08.2013 r. o terminach zapłaty w transakcjach handlowych (po nowelizacji - ustawa o przeciwdziałaniu nadmiernym opóźnieniom w transakcjach handlowych). Autorka poddaje analizie źródła uzasadnienia do wprowadzenia tego zakazu oraz jego zakres podmiotowy i przedmiotowy. Celem artykułu jest ustalenie, czy konstrukcja prawna zakazu może pozwolić na osiągnięcie zamierzenia, jakim jest ograniczenie zatorów płatniczych.

This article critically discusses how legal frameworks in the Czech Republic and Poland correspond to the requirements of ECN+ Directive with regard to the powers of NCAs. For that purpose, the authors analyse the obligations of EU Member States – within this scope – under this directive, as well as legal frameworks in the Czech Republic and Poland. Subsequently, the article compares the manner of regulating these issues in the national legal orders of these countries to the standard required by ECN+ Directive. The aim of this publication is to verify whether, and how, these two EU Member States meet those requirements, and to determine any potential differences in the approach taken by legislators in these EU Member States.
