A wide margin of discretion by a given contracting authority to shape competition rules in procedures not covered by The Provisions of The Public Procurement Law shall give the possibility to strengthen its actions aimed at ensuring competitiveness and transparency. This is reflected in the internal rules set up by the contracting authorities, the design of which shall provide a theoretical framework aimed at ensuring the competitiveness in question. The author, based on the Ordinance of the Mayor of the City introducing the Order Regulations, excluding the Act, has attempted to identify areas that build competitive in procurement. Moreover, he proposed and described the copyright dimensions of the competitiveness, as well as, pointed out measures and indicators enabling the measurement of competitiveness of public procurement.

Duża dowolność w kształtowaniu reguł konkurencyjności w procedurach nieobjętych przepisami ustawy Pzp przez danego zamawiającego daje możliwość umacniania jego działań skierowanych na zapewnienie konkurencyjności i przejrzystości. Wyrazem tego są tworzone przez zamawiających regulaminy wewnętrzne, których konstrukcja powinna dawać teoretyczne ramy ukierunkowane na zapewnienie rzeczonej konkurencyjności. Autor w oparciu o Zarządzenie Prezydenta Miasta wprowadzające Regulamin zamówień poza ustawą dokonał próby zidentyfikowania obszarów budujących konkurencyjność zamówień. Ponadto zaproponował i opisał autorskie wymiary rozpatrywania konkurencyjności oraz wskazał mierniki i wskaźniki umożliwiające pomiar konkurencyjności zamówień publicznych.

The issue of choosing the commune executive body is important both from a democratic, and a social point of view. In the theoretical-practical article, an attempt was made to: − cataloging the most important legal acts and other regulations focused on local government elections (from the perspective of choosing the commune executive body); − indication of changes in the electoral law made in 2018 that are the background to the practical part of the article; − defining the role of local government as the organizer of local government elections among other entities involved in the preparation and conduct of the elections. In addition, using the example of the city of Dąbrowa Górnicza, organizations of local government elections were presented from the point of view of the selection of the commune executive body (in particular, its organizational aspect against the results).

Problematyka wyboru organu wykonawczego jest ważna zarówno z demokratycznego, jak i społecznego punktu widzenia. W artykule o charakterze teoretyczno-praktycznym podjęto próbę: − skatalogowania najważniejszych aktów prawnych i innych regulacji skoncentrowanych wokół wyborów samorządowych (z perspektywy wyboru organu wykonawczego); − wskazania zmian w ordynacji wyborczej dokonanych w 2018 r. będących tłem do części praktycznej artykułu; − określenia roli samorządu terytorialnego jako organizatora wyborów samorządowych wśród innych podmiotów uczestniczących w przygotowaniu i przeprowadzeniu wyborów. Ponadto posługując się przykładem miasta Dąbrowa Górnicza, przedstawiono organizację wyborów samorządowych z punktu widzenia wyboru organu wykonawczego (w szczególności jego aspekt organizacyjny na tle wyników).

Summarising issues discussed in this article, one shall acknowledge that social services encompassing health care, education, culture and leisure are a particular area of scientific research and constitute a complex subject to be analysed. It is connected with features of social services around which there are much controversy mainly over the inability to differentiate services (activities) from their intangible effect, service substitution and different effects of social services and tools for rendering the services. There are some difficulties concerning the specification of features of social services and in reference books it is mainly connected with defining public goods and different criteria of distinguishing. Social services take a significant place in the service classification, both in the one on the basis of different theoretical and scientific criteria as well as statistical identification. Social services are aimed at intellectual and cultural development as well as health improvement of the human being. In the modern economy and society one shall indicate the consumption of social services, their function and meaning in the creation of human resources which determine proper development processes. This article is an attempt to define social services as “purposeful and organized activities of institutions of social policy which aim to satisfy needs of the local community in the range of education, health care and culture financed from public funds with support of income of the society depending on the social policy of the state”.

Artykuł prezentuje definicje usług społecznych, odwołując się głównie do przedstawicieli nauk ekonomicznych, polityki społecznej i socjologii. W tekście wskazano ujęcie tej kategorii badawczej na płaszczyźnie administracji publicznej (samorządu terytorialnego). Poprzez zaprezentowany bogaty aparat pojęciowy i różne nurty definicyjne autor dokonał próby własnego zdefiniowania tych usług.
