The paper provides an overview of the selected aspects of the fiscal law of the Ottoman Empire between 1839 and 1876. In particular, the emphasis is placed on examining the evolution of state taxes in the context of the system as well as the institutions of the state budget, which were based on the rules of Sharia law in the early stages of the Ottoman statehood, while a general tendency towards their westernization was noticeable from 1839 onwards.

Artykuł stanowi przegląd wybranych aspektów prawa skarbowego Imperium Osmańskiego w latach 1839–1876. Nacisk położono w nim na zbadanie ewolucji podatków państwowych w kontekście ustrojowym oraz instytucji budżetu państwa, które we wczesnym etapie państwowości osmańskiej oparte zostały na regułach prawa szariatu, zaś od 1839 r. widoczna stała się tendencja do ich westernizacji.

This paper conducts a system review of Ottoman state legislation from 1867 to 1868 concerning the establishment and organization of the Council of State (Şura-yı Devlet) of the Ottoman Empire. In particular, the contents of the Organic Ordinance of the Council of State and source materials concerning the reasons for the establishment of the Council of State, including Sultan Abdülaziz’s speech (Nutk-ı Hümâyûn) and La Turquie et le Tanzimât by Edouard Engelhardt, were analyzed. The present analysis of the history of the Ottoman Council of State until 1868 also provides an overview of the most important system of state institutions in the Ottoman Empire, which were responsible for the legislative process as well as for the quasi-administrative judiciary in the period before the establishment of Şura-yı Devlet.

W artykule dokonano przeglądu ustrojowego prawodawstwa osmańskiego z lat 1867–1868 dotyczącego powołania oraz organizacji Rady Stanu (Şura-yı Devlet) Imperium Osmańskiego. Szczególnej analizie poddano treść rozporządzenia organicznego Rady Stanu oraz materiały źródłowe dotyczące przyczyn powołania Rady Stanu, w tym przemówienia sułtana Abdülaziza (Nutk-ı Hümâyûn), i pracę La Turquie et le Tanzimât autorstwa Edourda Engelhardta. Analiza historii osmańskiej Rady Stanu do 1868 r. uwzględnia także przegląd najważniejszych osmańskich instytucji ustrojowych odpowiadających za proces ustawodawczy oraz sądownictwo quasi-administracyjne w epoce poprzedzającej powołanie Şura-yı Devlet.
