Joseph Ratzinger, zarówno jako prefekt Kongregacji Nauki Wiary, a przede wszystkim jako papież wniósł wielki wkład w rozwój i implementację prawa kanonicznego. Za szczególnie znaczące należy uznać skierowane przez niego, jako Najwyższego Pasterza, do seminarzystów wezwanie do postawy miłości wobec prawa kanonicznego. W niniejszym artykule poddamy analizie jego wkład w rozwój doktryny kanonicznej w kwestiach poruszanych w przemówieniach do członków Roty Rzymskiej. Przedstawia on w nich kryteria postępu w znajomości i praktyce prawno-kanonicznej i odrzuca błędy, które mogą prowadzić do pewnych nadużyć. Szczególnie godny uwagi jest nacisk na ukazanie pastoralnej wartości prawa kanonicznego oraz na potrzebę zachowania jego ścisłego związku zarówno z miłością, jak i z prawdą. Z drugiej strony papież zwraca także uwagę na małżeństwo, zarówno w kwestii przygotowania do jego zawarcia, jak też obrony jego istotowych właściwości.

Joseph Ratzinger, both as Prefect of the Congregation for the Doctrine of the Faith and, above all, as Pope, contributed greatly to the legislative development and the implementation of Canon Law. His invitation has been especially important, as Supreme Pontiff, to the seminarians to love Canon Law. In this article we study his contribution to the canonical doctrine with the subjects developed in the speeches before the Roman Rota, in which He offers certain criteria to advance in the knowledge and praxis of Canon Law and rejects the errors that can create deviations. Particularly noteworthy is the insistence on showing the pastoral value of Canon Law and the need to hold its close link both to charity and to truth. On the other hand, the Pope also pays attention to marriage, both in preparation for it and in the defence of its essential properties.

Joseph Ratzinger, sowohl als Präfekt der Glaubenskongregation, und vor allem als Papst, trug wesentlich zum Entwicklung und Implementierung des kanonischen rechtes bei. Vor allem soll man seinen Aufruf als den Obersten Hirten bemerken, den er an Seminaristen richtete, damit sie lernen, das kanonische Recht zu lieben. Im folgenden Artikel wird sein Beitrag zur Entwicklung der kanonischen Rechtsdoktrin anhand der Ansprachen an die Rota Romana analysiert. Ratzinger stellt darin einige Entwicklungskriterien in Kenntnis des kanonischen Rechtes und seiner praktischen Anwendung dar und verweist auf Fehlentwicklungen, welche zum Missbrauch führen können. Bemerkenswert sind vor allem die Betonung des pastoralen Wertes des kanonischen Rechtes sowie die Notwendigkeit, seine enge Verbindung sowohl mit der Liebe als auch mit der Wahrheit zu bewahren. Auf der anderen Seite wird auch die Eheproblematik akzentuiert, sowohl im Bereich der Ehevorbereitung, als auch hinsichtlich der Verteidigung ihrer wesentlichen Merkmale.
