The division of assets after the dissolution of a same-sex relationship generates an increasing number of problems in relation to the institutionalization of both same-sex and different-sex relationships in different EU countries. Polish law does not recognize civil partnerships or same-sex marriages. However, it has become more common for a same-sex partners from a marriage registered outside Poland to acquire rights under the rules of common marital property law in force in another country, which has legal consequences under Polish law. In practice, in day-to-day matters and in legal transactions, partners act on the basis of very specific powers of attorney, granting them a much wider range of rights than those to which spouses are authorized under the common marital property law.

One of the risks society has to cope with nowadays is the unauthorised acquisition of personal and real estate data recorded in land and mortgage registers. The problems involved in the prevention of risks of this kind are proportional to the amount of information recorded in generally accessible land and mortgage registers which guarantee the truth and accuracy of such data. One of the challenges facing public administrative bodies is to work together with the judiciary to protect the data in land and mortgage registers and the documents attached to them, while at the same time ensuring the accessibility of the land and mortgage registers, which are the instruments guaranteeing the security of conveyancing.

Współcześnie występują zagrożenia przejawiające się w nieuprawnionym pozyskiwaniu danych osobowych oraz danych dotyczących nieruchomości, które zawarte są w księgach wieczystych. Zapobieganie takim ryzykom staje się tym trudniejsze, im więcej informacji zostało wpisanych w jawnie prowadzonych księgach wieczystych dających rękojmię ujawnionych w nich treści. W takich uwarunkowaniach wyzwaniem dla administracji staje się wspólne z wymiarem sprawiedliwości umożliwienie ochrony treści ksiąg wieczystych i dokumentów dołączonych do ich akt, a jednocześnie zapewnienie powszechnego dostępu do ksiąg wieczystych jako gwaranta obrotu nieruchomościami.
