The article describes the process of the reconstruction and protection of the Polish minority and Polish heritage in Lviv after 1991. This process is presented in the context of Polish-Ukrainian relations. The author indicates the most important actors in this process, focusing on presenting this phenomenon in spatial terms. Next, he describes achievements and possibilities for further development, in addition to the causes and effects of the phenomenon.

Rozważając problem reformowania szkolnictwa wyższego autor stawia tezę, iż z jednej strony podlega ono stałemu procesowi przeobrażeń, z dmgiej zaś - mimo niejednokrotnie gwałtownych zmian formacji społecznych, kryzysów politycznych oraz nowych oczekiwań formułowanych wobec kształcenia - niektóre elementy rzeczywistości szkolnictwa wyższego cechuje trwałość, powodująca, że wykazuje ono daleko mniejszą podatność na zmiany niż otaczający je świat. Analizując różnorodne elementy funkcjonowania uczelni i ich znaczenie dla powodzenia kształcenia i wychowania autor przypisuje decydującą rolę stosunkowi, który zachodzi między nauczycielem i uczniem. Podkreśla znaczenie „autonomii kompetencji” (polegającej na tym, że nauczyciela obowiązuje ponad wszystko lojalność wobec metody naukowej, logiki i poprawności rozumowej, wobec treści badań i sprawdzonych niezawodnie tez) oraz „autonomii dydaktyki” (lojalność wobec metod skutecznego działania dydaktycznego). Ów zakres rzeczywistości uczelni najtrudniej ulega przekształceniom. Jeśli w tej sferze reforma osiągnie sukces, można się spodziewać trwałych i istotnych zmian.

Discussing the limits to the reform of the university, the Author presumes that universities undergo continues transformations. On the other hand however, despite of rapid social changes, political crisis and new demands, some university patterns are remarkably stable. This steadiness proves their slight, as compared to surrounding institutions, vulnerability to change. When analyzing various components of university activities and their influence upon the successful education and upbringing process, the Author attributes the decisive role to the tutor-student relationship. Also, he underlines the meaning of the „autonomy of skills” (based on the tutor’s principal obligation to observe scientific methods and logics and reasoning correctness in face of proved thesis and given research objects) and the „autonomy of didactics” (based on the tutor’s obligation to follow effective educational methods). According to the Author, the student-tutor relationship is least vulnerable to transformations. If the reform is successful in this area, one may expect the enduring and substantial transformation of universities.

The paper focuses on the issue of anti-tax avoidance regulation in the German legal system and the important role of judicial decisions in the general discussion on this topic. The position of the legal doctrine as well as the general anti-abuse rule addressing the tax-avoidance problem, currently in force in Germany, are presented. This is followed by an analysis of the decisions delivered by the last instance finance and tax tribunal Bundesfinanzhof, including the so called Gesamtplanrechsprechung which presents, in detail, views and opinions of German courts regarding combatting tax avoidance practices. Such a structure of the paper aims to serve as comparative material and a voice in the discussion on the ways of tackling tax avoidance.

Autor skupia się na problemie unikania opodatkowania w niemieckim systemie prawnym i upatruje ważny element w dyskusji na temat tego zjawiska w niemieckim orzecznictwie sądowym. Obok rozważań doktryny na temat odpowiedniej ustawowej regulacji dotyczącej opisywanego zjawiska, zaprezentowana została ustawowa regulacja ogólnej klauzuli przeciwko unikaniu opodatkowania. Całość opracowania dopełniona została analizą rozwojowego orzecznictwa (tzw. Gesamtplanrechsprechung) najwyższego niemieckiego sądu właściwego w sprawach podatkowych (Bundesfinanzhof), która w sposób szczególny ukazuje poglądy niemieckich sądów podatkowych dotyczące walki z unikaniem opodatkowania. Tak ukształtowany artykuł ma stanowić materiał komparatystyczny i głos w dyskusji na temat sposobów przeciwdziałania unikaniu opodatkowania (obejście ustawy podatkowej).

The article contains an outline for the ceremony of the First Communion of children in the parochial church. It is based on historical research investigating the ways of preparing children for the First Communion in the Catholic Church of Western Europe and in Poland. The goal of this article is to create a new, original concept of this ceremony in order to improve the participation of children and all the faithful in a better and deeper experience of the First Communion. The liturgy is meant to be easier to comprehend by the children. In the rites one of the ways of supporting those attempts will be through children’s gestures performed during the renewal of baptismal promises.
