This article presents legal aspects of digital repositories created by research institutions in Poland. Under the “Law on copyright and associated rights” issues related to works’ protection and their copyright disposal, as well as legal context of material archiving in repositories by different groups of depositors, were discussed. The article approaches also the subject of making available works in the open-access model and the possibilities of its implementation by means of free licenses.

W artykule przedstawiono prawne aspekty funkcjonowania repozytoriów cyfrowych tworzonych przez instytucje naukowe w Polsce. W oparciu o przepisy „Ustawy o prawie autorskim i prawach pokrewnych” omówiono kwestie ochrony utworów i dysponowania prawami autorskimi do nich oraz zaprezentowano prawny kontekst archiwizacji materiałów w repozytoriach przez różne grupy deponentów. Przybliżono również temat udostępniania utworów w modelu otwartym oraz możliwości jego realizacji za pomocą wolnych licencji.
