The article contains information on the concept of sport and physical culture, as well as the ways of financing them by municipalities. Sport is a phenomenon that can be observed everywhere these days. For some it is a way to spend their free time, relax and take care of their health, and for others it is a source of income. Providing appropriate conditions for practicing sports is an important aspect of activities for central authorities and local government units. To ensure appropriate sports infrastructure, it is necessary to ensure its development and ensure appropriate legal and financial conditions at the lowest level of the structure of public bodies. Local governments face the problem of obtaining financial resources for sports and their appropriate distribution. The aim of the article is to analyze the expenses incurred on sports in the commune and city of Jedlnia-Letnisko, as well as the sources from which they are covered. The article uses the dogmatic method and the method of legal functionalism. The dogmatic method will be used to interpret and analyze the application of legal provisions and to formulate specific conclusions. However, the method of legal functionalism will be used to analyze a specific legal situation in case law.

W artykule zostały zawarte informacje dotyczące pojęcia sportu oraz kultury fizycznej, a także sposobów ich finansowania przez gminy. Sport to zjawisko, które w dzisiejszych czasach można zaobserwować na każdym kroku. Dla jednych jest to sposób na spędzenie wolnego czasu, relaks, zadbanie o zdrowie, a dla innych stanowi źródło dochodu. Zapewnienie odpowiednich warunków do uprawiania sportu jest ważnym aspektem działań dla władz centralnych, a także jednostek samorządu terytorialnego. Dla zapewnienia odpowiedniej infrastruktury sportowej, należy zadbać o jej rozwój oraz zapewnić odpowiednie warunki prawne, a także finansowe już na najniższym poziomie struktury organów publicznych. Samorządy stoją przed problemem pozyskiwania środków finansowych na sport, a także ich odpowiedniego podziału. Celem artykułu jest analiza wydatków ponoszonych na sport w gminie Jedlnia-Letnisko, a także źródeł z których są one pokrywane. W artykule wykorzystana została metoda dogmatyczna, a także metoda funkcjonalizmu prawniczego. Metoda dogmatyczna posłuży do wykładni i analizy stosowania przepisów prawnych oraz sformułowania określonych wniosków. Natomiast metoda funkcjonalizmu prawniczego posłuży do analizy konkretnego stanu prawnego w orzecznictwie.

The article aims at a legal and administrative analysis of the position of the mayor of the municipality. The paper presents the method of selection, as well as the issues of dismissal of the mayor of the municipality. The aim of the publication is to analyse the legal status of the mayor of the municipality. The text addresses issues of election and dismissal of the mayor of the municipality, as well as his role and competences. In the following, anti-corruption restrictions concerning the mayor of the municipality are also mentioned. The work will use the dogmatic method, as well as the method of legal functionalism. The dogmatic method will be used to interpret and analyse the application of legislation and to formulate specific conclusions. On the other hand, the method of legal functionalism will be used to analyse a specific legal situation in case law. The paper takes into account current legal issues with reference to, among others: the Act of 8 March 1990 on Municipal Self-Government, the Act of 20 June 2002 on the Direct Election of the Governor, the Mayor and the Mayor of the City, the Act of 5 January 2011 on the Electoral Code, the Act of 21 August 1997 on the Restriction of Business Activity by Persons Performing Public Functions, the Act of 21 November 2008 on Local Government Employees, as well as the and literature of the subject.

Artykuł ma na celu prawno-administracyjną analizę pozycji wójta gminy. W pracy przedstawiony został sposób wyboru, a także kwestie odwołania wójta gminy. Celem publikacji jest analiza statusu prawnego wójta gminy. W tekście poruszone zostają kwestie wyboru i odwołania wójta gminy, a także jego zadania i kompetencje. W dalszej części przywołane zostają również ograniczenia antykorupcyjne, które dotyczą wójta gminy. W pracy wykorzystane zostaną metoda dogmatyczna, a także metoda funkcjonalizmu prawniczego. Metoda dogmatyczna posłuży do wykładni i analizy stosowania przepisów prawnych oraz sformułowania określonych wniosków. Natomiast metoda funkcjonalizmu prawniczego posłuży do analizy konkretnego stanu prawnego w orzecznictwie. W pracy uwzględniono aktualne zagadnienia prawne powołując się m.in. na: ustawę z dnia 8 marca 1990 r. o samorządzie gminnym, ustawę z dnia 20 czerwca 2002 r. o bezpośrednim wyborze wójta, burmistrza i prezydenta miasta, ustawę z dnia 5 stycznia 2011 r. Kodeks wyborczy, ustawę z dnia 21 sierpnia 1997 r. o ograniczeniu prowadzenia działalności gospodarczej przez osoby pełniące funkcje publiczne, ustawę z dnia 21 listopada 2008 r. o pracownikach samorządowych, a także orzecznictwo oraz literaturę przedmiotu.

The article aims at a legal-administrative analysis of the position of the city council. The thesis describes how a city councillor has been elected and obtained a mandate, as well as the cases in which the mandate is suspended or terminated. The article deals with the duties and powers of the councillor. It discusses prohibitions and restrictions imposed on a city council in the exercise of its functions.

Artykuł ma na celu prawno-administracyjną analizę pozycji radnego. W pracy przedstawiony został sposób wyboru oraz nabycia mandatu przez radnego, a także przypadki, w których mandat ulega zawieszeniu lub wygaśnięciu. W artykule dokonana została analiza obowiązków oraz uprawnień, które posiada radny. Omówione zostały zakazy i ograniczenia dotyczące radnego w związku z wykonywaną przez niego funkcją.
