II wojna światowa spowodowała załamanie zasad panujących w dotychczasowym świecie. Okrucieństwo działań wojennych, które dotyczyło również osób cywilnych uświadomiło społeczności międzynarodowej, że przyjęte dotychczas zasady humanitaryzmu są niewystarczające. Świat domagał się osądzenia zbrodniarzy wojennych. W tamtym momencie nie istniał żaden sąd międzynarodowy, który mógłby podjąć się tego wyzwania. Utworzone zostały dwa trybunały: Międzynarodowy Trybunał Wojskowy z siedzibą w Norymberdze oraz Międzynarodowy Trybunał dla Dalekiego Wschodu z siedzibą w Tokio, których zadaniem było osądzenie najpoważniejszych zbrodni popełnionych w czasie II Wojny Światowej. Ludność cywilna, a zwłaszcza kobiety narażone zostały na cierpienie związane ze stosowaną przemocą seksualną i gwałtami. Międzynarodowy Trybunał dla Dalekiego Wschodu nie przemilczał tematu zbrodni na tle seksualnym podjął się osądzenia zbrodniarzy wojennych, którzy odpowiadali również za popełnione gwałty. Działania Międzynarodowego Trybunału dla Dalekiego Wschodu były jednymi z pierwszych kroków w historii w zakresie karania zbrodni gwałtu popełnianego podczas konfliktów zbrojnych i wpłynęły na rozwój międzynarodowego prawa karnego w tym zakresie.

The Second World War caused the collapse of the rules prevailing in the world so far. The cruelty of warfare, which also affected civilians, made the international community aware that the principles of humanitarianism adopted so far are insufficient. The world demanded that war criminals be brought to justice. At that point, no international court existed to take on the challenge. Two tribunals were established – the International Military Tribunal based in Nuremberg and the International Tribunal for the Far East based in Tokyo, whose task was to try the most serious crimes committed during II World War. The civilian population, especially women, suffered from sexual violence and rape. The International Tribunal for the Far East did not remain silent on the subject of sex crimes and undertook to judge war criminals who were also responsible for rapes. The actions of the International Tribunal for the Far East were one of the first steps in history in the field of punishing the crime of rape committed during armed conflicts and influenced the development of international criminal law in this area.

Shaped over the centuries, the laws and customs of war have always included rules based on the principle of chivalry, a sense of humanity directed at protecting non-combatants. Most of the victims of today’s armed conflicts are civilians, mainly women and children. The problem of rape and sexual violence during armed conflict particularly affects women. Rape committed in war is used to terrorize the population, break up families, destroy communities, sometimes also to change the ethnic structure of successive generations. Sexual violence is a violation of international humanitarian law of armed conflict, but we have often seen in history that this issue has been passed over in silence or treated as a side effect of war. Special attention should be paid to the criminalization of sexual violence. The UN Security Council only recognized the problem of sexual violence in armed conflict in 1992, when news of the mass rape of women and girls in the former Yugoslavia circulated around the world. In December 1992, the UN adopted a declaration that “the mass, organized and systematic detention and rape of women in Bosnia and Herzegovina, particularly Muslim women, is an international crime that must be prosecuted” (UN Security Council, 1992). Unfortunately, during and in the immediate aftermath of conflicts, it remains extremely difficult to bring justice to perpetrators of violence against women.
