Poprzez wprowadzenie ustawy o zarządzie sukcesyjnym przedsiębiorstwa osoby fizycznej od niedawna działalność gospodarcza może zostać kontynuowana pomimo śmierci przedsiębiorcy. Na podstawie tego rozwiązania osoba fizyczna (przedsiębiorca) może powołać następców prawnych (spadkobierców) w celu podjęcia przez nich decyzji dotyczącej dalszego położenia i funkcjonowania działalności gospodarczej. Celem artykułu jest zatem przybliżenie tej nowej instytucji oraz zarekomendowanie, aby w powyższym przypadku zawczasu został powołany zarządca sukcesyjny, który może umożliwić prowadzenie działalności gospodarczej w dalszym ciągu. Autor przedstawienia praktyczne podejście do ujętych rozważań w przedmiocie zarządu sukcesyjnego. Artykuł zawiera uwagi i wskazówki dla przedsiębiorców niezbędne do zrozumienia i korzystania z tejże instytucji.

By introducing the act on the succession management of a natural person’s enterprise, the economic activity may be continued, despite the entrepreneur’s death. On the basis of this solution, a natural person (entrepreneur) may appoint legal successors (heirs) in order to make a decision concerning further location and functioning of economic activity. The aim of the article is, therefore, to familiarize readers with this new institution and to recommend that in the above case a successive manager should be appointed in advance, which may enable continuation of business activity. The advantage of the article is, thus, presentation of a practical approach to the considered issues within the area of succession management. The article includes many valuable remarks and guidelines for entrepreneurs, which are necessary to understand and to make use of this institution59
