In recent years, the UN Security Council has been increasingly criticized for being selective and applying double standards in response to humanitarian crises. This difference in action raises questions about what motivates the United Nations to respond. In this article, the author identifies reasons for the selectivity of interventions motivated by humanitarian factors.

W ostatnich latach Rada Bezpieczeństwa ONZ coraz częściej krytykowana jest za wybiórczość i stosowanie podwójnych standardów w reakcji na kryzysy humanitarne. Ta różnica w działaniu stwarza pytania, jakie czynniki motywują Organizację Narodów Zjednoczonych do reakcji. W artykule autor wskazuje powody selektywności interwencji motywowanych czynnikami humanitarnymi.

Since its inception, the United Nations has devoted much attention to the issue of access to humanitarian aid. Its activities in this area focus on a number of levels – including the judicial one. The UN Security Council in December 2022 adopted a resolution establishing a cross-cutting exception to current and future UN sanctions. It obliged all UN Member States to carry out certain humanitarian aid activities hitherto considered to be sanctions violations. This resolution represents a groundbreaking change in the UN sanctions regime, protecting and supporting humanitarian activities against any financial prohibitions imposed by UN sanctions regimes. The humanitarian exemptions represent a turning point in the Council’s reconciliation of the imperatives of international security and humanitarian security.

Organizacja Narodów Zjednoczonych od momentu powstania wiele uwagi poświęca zagadnieniu dostępu do pomocy humanitarnej. Jej działalność w tym zakresie koncentruje się na wielu płaszczyznach, w tym jurydycznej. Rada Bezpieczeństwa ONZ w grudniu 2022 r. przyjęła rezolucję ustanawiającą przekrojowy wyjątek od obecnych i przyszłych sankcji ONZ. Zobowiązała wszystkie państwa członkowskie ONZ do niektórych działań związanych z udzielaniem pomocy humanitarnej, uznawanych dotychczas za naruszenie sankcji. Rezolucja ta stanowi przełomową zmianę w systemie sanacyjnym ONZ, chroniąc i wspierając działalność humanitarną przed wszelkimi zakazami finansowymi ustanowionymi przez reżimy sankcyjne ONZ. Wyłączenia humanitarne stanowią punkt zwrotny w pogodzeniu przez Radę imperatywów bezpieczeństwa międzynarodowego i bezpieczeństwa humanitarnego.
