Polish model of cultural property protection by the aid of the criminal law has existed for over 100 years and it is commonly considered well-functioning and highly developed. It is composed of the provisions of the Penal Code and Act on the protection and care of antiques. The subject of this article are the newly introduced criminal provisions of the Act on the protection and care of antiques. Both changes introduced by the legislator and old regulations are subject to consideration. The article also analyzes the legislative process of the amendment, the ratio legis of the proposed provisions, as well as their justification in the context of the entire act.

Polski model karnoprawnej ochrony dóbr kultury istnieje od ponad 100 lat i powszechnie uznawany jest za dobrze funkcjonujący i wysoko rozwinięty. Składają się na niego zarówno przepisy zawarte w Kodeksie karnym, jak i w ustawie o ochronie zabytków i opiece nad zabytkami. Przedmiotem niniejszego artykułu są nowo wprowadzone przepisy karne ustawy o ochronie zabytków i opiece nad zabytkami. Rozważaniom zostają poddane zarówno wprowadzone przez ustawodawcę zmiany, jak i przepisy. W artykule analizie poddano również proces legislacyjny nowelizacji, ratio legis proponowanych przepisów, a także ich zasadność w kontekście całej ustawy.
