This article aims to analyse whether the social control over the administration will play any important role when the administration is going to be performed through the Artificial Intelligence algorithms. It seems that currently this method of controlling the administration is important to ensure that the administration is still integrated into a democratic state ruled by law. However, applying the Artificial Intelligence in the administration process may lead to the situation where the transparency of administrative process is significantly reduced. This may be due to the nature of algorithms. The humans are not able to “decode” or recreate the way the algorithm investigates and solves the given problem. Therefore there is a risk that democratic state may turn into the “technological anocracy” or even into the “technological authoritarianism”. In addition, reckless use of Artificial Intelligence in the administrative process may reverse the values of administrative law itself understood as the law which protects an individual against the abuse of administrative authority. The paper contains also the suggestions in changing the way of exercise the social control over the administration to ensure the democratic standards in the administrative process.

The main aim of this work is to analyze the consequences voivodeship administrative court’s ruling which revokes the opposition to registration on the legal counsel’s list issued by the Ministry of Justice. The main issue here is the fact, that due to Article 152 § 1 of the Act on Administrative Courts Proceedings, the effect of a ruling which revokes the administrative act is that the legal effects of such an act are suspended until the court’s ruling will not be final and enforceable. In such a case, an important question arises – should the competent authorities of the National Bar of Attorneys-at-Law assume that the registration on the attorneys at law’s list is legal and as a result set the date for the candidate to take the oath? The analysis of the law and the nature of the Ministry’s objection leads to conclusions that the aforementioned effect of Article 152 § 1 does not occur in such a case. This is due to the dual nature of the objection. On the one hand, it is an administrative act (conventional activity), but on the other hand, it is part of the hypothesis of the legal norm preventing the release of the disposition. As a result, it can be assumed that the objection in this regard is a factual act.

The paper is a contribution to the ongoing discussion regarding the issue of withdrawing permits to run a generally accessible pharmacies in the context of exceeding of so-called concentration limits. In the study, authors claim that in the period between coming into force of the regulation "Pharmacy for Pharmacist" ("apteka dla aptekarza" - 2017) until the amendment of art. 99 of the Pharmaceutical Law of 2023, there was no legal basis for withdrawal by public authorities a permit to run pharmacy due to the exceeding concentration limits. What is more, authors claim that in particular article 37ap of the Pharmaceutical Law could not be considered legal grounds for such actions. Only after the amendment of article 99 of the Pharmaceutical Law (by Act of 13 July 2023 amending the Act on export insurances guaranteed by the State Treasury and certain other acts), possibility of applying sanctions towards entrepreneur who exceeded concentration limits, was introduced to the legal system.

Artykuł stanowi głos w toczącej się dyskusji dotyczącej problematyki cofania zezwoleń na prowadzenie aptek ogólnodostępnych w związku z przekroczeniem tzw. progów antykoncentracyjnych. W opracowaniu autorzy stawiają tezę, że w czasie od wejścia w życie rozwiązań prawnych zwanych „apteka dla aptekarza” (2017 r.) do czasu nowelizacji art. 99 ustawy Prawo farmaceutyczne z 2023 r. nie istniała podstawa prawna do cofania zezwolenia na prowadzenie apteki z powodu przekroczenia progów antykoncentracyjnych. W szczególności niemożliwe było, aby podstawę prawną do cofnięcia zezwolenia stanowił samoistnie art. 37ap ustawy Prawo farmaceutyczne. Dopiero zmiana art. 99 Prawa farmaceutycznego dokonana na mocy ustawy z 13.07.2023 r. o zmianie ustawy o gwarantowanych przez Skarb Państwa ubezpieczeniach eksportowych oraz niektórych innych ustaw wprowadziła do systemu prawa możliwość zastosowania sankcji w przypadku przekroczenia przez przedsiębiorcę progów antykoncentracyjnych.

Global warming is of key importance among the many negative manifestations of human impact on the environment. The main cause of climate change and the observed global warming is the emission of greenhouse gases (GHG) into the atmosphere, while the largest share of emissions is generated by transportation sector. It is declared that by 2050 GHG emissions in the transportation sector will be reduced by 90 per cent. In the part relating to road transport, a key role is to be played by digitization, transport automation, the use of intelligent traffic control systems and the abandonment of combustion engines in favour of electric ones. This study aims to present possible legal solutions aimed at introducing eco-routing solutions for vehicle traffic in the EU and obstacles to its widespread implementation and is aimed to begin discussion about this matter and the further studies in this area.
