Restrictions as regards owning shares by a Deputy do not apply to commercial law compa- nies, where the ownership structure is solely private. However, investing in capital markets by a Deputy each time requires taking into account principles of Deputies’ ethical code. In ad- dition, if the bene t from investment exceeds PLN 380, a Deputy is obliged to include it in the bene t register.

Bankowy Fundusz Gwarancyjny prowadzi unikatową bazę danych związanych z sektorem finansowym, niezbędną dla realizacji funkcji publicznych określonych w ustawie o Bankowym Funduszu Gwarancyjnym. Prywatnymi podmiotami zobowiązanymi do przekazywania informacji są: banki, spółdzielcze kasy oszczędnościowo-kredytowe, zarząd komisaryczny banku lub podmiot uprawniony do jego reprezentacji, zarządca masy upadłości, syndyk, Kasa Krajowa skok, likwidator spółdzielczej kasy oszczędnościowo-kredytowej, bank spółdzielczy, bank zrzeszający. Do publicznych podmiotów przekazujących informacje do BFG należą: Komisja Nadzoru Finansowego, Prezes Narodowego Banku Polskiego, Minister Finansów oraz Najwyższa Izba Kontroli. Na mocy porozumień Fundusz może otrzymywać informacje od podmiotów odpowiedzialnych za oficjalnie uznane systemy gwarantowania w państwach EOG i UE.

The Bank Guarantee Fund operates a unique database regarding the financial sector. The uniqueness of this is due to fullfilement of public functions referred to in the Act on the Bank Guarantee Fund. In the private sector, the following are obliged to transmit information: banks, credit unions, bank receiverships or entities entitled to their representation, trustees in bankruptcy, the National Credit Union, a liquidator of credit unions, a cooperative bank, a community bank. Public entities transmitting information to the BFG include: the Financial Supervision Authority, the President of the National Bank of Poland, the Minister of Finance and the Supreme Chamber of Control. Beyond that, the Fund may receive information from entities responsible for officially recognised deposit-guarantee schemes in Member States of the EEA and the EU.

The opinion contains an analysis of duties of a Deputy as an administrator within the meaning of the General Data Protection Regulation (GDPR). The problem of a consent to data processing by the Deputy’s office is discussed herein, as well as its features on the basis of GDPR and the guidelines by Article 29 Data Protection Working Party and issues related to obtaining the consent of the person, whose personal data is to be processed. Matters related to protecting data are also presented. It is pointed that the control of implementing the GDPR is based on the provisions of the national law (the act on personal data protection).

The aim of the opinion is to assess the impact of the Government’s draft bill on interest rate subsidies for bank loans granted to provide financial liquidity to entrepreneurs affected by COVID-19 and amending certain other acts. The changes to the law made in this respect meet social expectations.
