At the end of the 20th as well as the beginning of the 21st century, a series of armed confl icts took place in Eastern Europe. The Russian Federation participated or supported one of the parties in almost every confl ict in this region. The author presents the arguments in favor of the thesis that such Russia’s actions are not of an economic but a political nature. The goal of such actions is the realisation of Russia’s desire to strengthen its political position in the neighboring countries, using tools which are unacceptable in the majority of countries in the world. The main aim of this article is to analyze the economic of the Eastern regions of Ukraine, especially the territories covered by the military confl ict. The author presents the economic importance of these regions for the economy of Ukraine through the analysis of the main macroeconomic indicators and government expenditures aimed at the development of this region. Also, the author attempts to compare the confl ict in Eastern part of Ukraine with other similar confl icts in Eastern Europe in which Russia participated.

Artykuł analizuje organizacje separatystyczne powstałe na wschodzie Ukrainy w 2014 r. – Republiki Ludowe Doniecką i Ługańską. Autor przedstawia podstawowe determinanty, od których zależy funkcjonowanie wspomnianych bytów quasi-państwowych: czynnik polityczny (zgoda w strukturach władzy i elity bytu quasi-państwowego co do realizacji celu danej jednostki); czynnik społeczny (wysokie poparcie ludności dla osiągnięcia tego celu); czynnik ekonomiczny (pozyskiwane środki finansowe i materialne); niski potencjał państwa macierzystego; patronat podmiotu zewnętrznego. Dostępne dane wskazują, że w przypadku analizowanych republik samozwańczych brakuje spoiwa politycznego czy ekonomicznego, choć istnieje prawdopodobieństwo umocnienia poparcia dla ich funkcjonowania wśród ludności lokalnej. Byty te stanowią przede wszystkim wygodne narzędzie dla prowadzenia specyficznej polityki zagranicznej Federacji Rosyjskiej wobec Ukrainy.

The article analyzes the separatist organizations, which came to existence in the east of Ukraine in 2014 - Donetsk and Luhansk People's Republics. The author analyzes the basic determinants of survival of these quasi-state entities: the political factor (agreement in the structures of power and elites of the quasi-state on their ultimate political objective); social factor (high level of public support to achieve this objective); economic factors (available financial and material resources); low potential of a parent state; patronage of external actor. Available data indicate that analysed self-proclaimed republics lack political or economic binder. On the other hand, there is a relatively high probability of strengthening of public support among local inhabitants for both organisations. Analysed entities constitute primarily a convenient tool for the conduct of specific foreign policy of the Russian Federation towards Ukraine.

W kwietniu 2014 r. grupa separatystów na wschodniej Ukrainie powołując się na prawo do samostanowienia narodów ogłosiła deklaracje niepodległości dwóch tzw. quasi-państw: Donieckiej Republiki Ludowej i Ługańskiej Republiki Ludowej. Artykuł ma na celu przeanalizowanie prawnych aspektów jednostronnej secesji tych podmiotów. W ramach opracowania poruszane są następujące kwestie – problematyka kryteriów państwowości, konflikt pomiędzy prawem do samostanowienia narodów a zasadą integralności terytorialnej w kontekście secesji w imię samostanowienia (remedial secession) i wreszcie kwalifikacji prawnej wsparcia udzielonego separatystom przez Federację Rosyjską. Szczegółowa analiza stanu faktycznego ujawnia bowiem, że prawo do secesji jest obecnie wykorzystywana przez kremlowski decydentów do ukrycia prawdziwej natury wojny toczącej się dzisiaj na wschodniej Ukrainie – agresji Federacji Rosyjskiej przeciwko niezależności i integralności terytorialnej ukraińskiego państwa.

In April 2014 the group of separatists in Eastern Ukraine claiming the right of nations to self-determination proclaimed the independence of two quasi-states: Donetsk People’s Republic and Luhansk People’s Republic. The aim of this article is to examine the legal facets of unilateral secession of this state-like entities. Paper deals with the problems of statehood criteria, the conflict between self-determination and territorial integrity principles within remedial secession context and finally with the legal qualification of Russian support for separatists movement. The thorough analysis of facts reveals that right to secede in the name of self-determination is currently used by the Kremlin policymakers to hide the real nature of ongoing war in Easter Ukraine – aggression of Russian Federation against sovereignty and territorial integrity of Ukrainian state.

В апреле 2014 г. группа сепаратистов на востоке Украины, опираясь на право на самоопределение народов объявила декларацию о независимости так называемых quasi -государств: Донецкой и Луганской Народной Республики. Статья направлена на анализ юридических аспектов одностороннего отделения. В рамках исследования рассматриваются следующие вопросы - вопрос о критериях государственности, конфликт между правом на самоопределение народов и принципoм территориальной целостности в контексте отделения во имя самоопределения (remedial secession) и, наконец, правовой квалификации поддержки сепаратистам со стороны Российской Федерации. Детальный анализ фактов показывает, что право на отделение в настоящее время используется Российской Федерацией, чтобы скрыть истинную продолжающейся войны на в Восточной Украине - агрессии Российской Федерации против независимости и территориальной целостности украинского государства.
