Komentowane orzeczenie Trybunału Sprawiedliwości Unii Europejskiej stanowi próbę rozstrzygnięcia sporu pomiędzy Groupement des Cartes Bancaires (zgrupowaniem francuskich banków) a Komisją Europejską. Trybunał odrzuca stanowisko Sądu Unii Europejskiej, który stwierdził, że środki zastosowane przez skarżące banki miały na celu ograniczenie konkurencji na rynku kart płatniczych we Francji. Interpretacja pojęcia „ograniczenia ze względu na cel” w świetle art. 101 ust. 1 TFUE, której dokonał trybunał, radykalnie zmienia dotychczasową linię orzecznictwa w tym przedmiocie i stanowi zapowiedź nowego, całościowego i bardziej ostrożnego podejścia do rozumienia antykonkurencyjnego „celu” porozumienia.

The commented judgment of the European Court of Justice constitutes an attempt to resolve a dispute between Groupement des Cartes Bancaires (a grouping of several French banks) and the European Commission. The Court rejects the stance of the General Court according to which the measures applied by the appellant banks had the aim of restricting competition on the market for payment cards in France. The interpretation of the notion of „restriction by object” in the light of Art. 101 (1) TFEU endorsed by the ECJ significantly alters its current view on this matter and may be foreshadowing a new, more comprehensive and careful approach to the reading of the anticompetitive “object” of an agreement.
